Özel görevli ağır ceza mahkemelerinin yapısı ve işleyişi

Abstract

Devlet Güvenlik mahkemelerinin kaldırılmasından sonra 5271 sayılı CMK'nın 250 ila 252. maddelerinde düzenlenen özel görevli ağır ceza mahkemelerinin hukuki statüsü ve işleyişi ele alınmıştır.Öncelikle mahkeme kavramı aktarılmış ve bu mahkemelere duyulan ihtiyaç tarihsel süreciyle açıklanmış, hukuki statüleri ve Türk yargı sistemindeki yeri yabancı ülkelerdeki örnekleriyle ortaya konmuştur. Bu mahkemelerin, tabii hâkim ilkesi, ihtisas mahkemesi niteliği ve olağanüstü yargı mercii olup olmadığı hususları incelenerek hukuka uygunlukları değerlendirilmiştirÖzel görevli ağır ceza mahkemelerinin yargı alanı yetki ve görev bakımından incelenmiş, görevi belirleyen temel unsur olan örgüt olgusu ve organize suç kavramı ulusal üstü boyutu ve yabancı ülkelerdeki karşılıklarıyla ele alınmıştır. Görev konusuna ilişkin uygulamada karşılaşılan sorunlar ve tartışmalı konulara yer verilmiştir. Bu mahkemelerdeki yargılama süreci üç bölüm halinde; soruşturma evresi, kovuşturma evresi ve kanun yolu evresi olarak, Devlet güvenlik mahkemeleri zamanındaki düzenlemelerle karşılaştırılıp, hatalı, eksik yönleri ve uygulamadaki yanlışlıklar ortaya konulmak suretiyle açıklanmıştır.Anahtar Kelimeler: Mahkeme, Özel görevli mahkeme, Devlet güvenlik mahkemesi, Hukuki statü, Türk yargı sistemi, Örgüt, Organize suç.

Legal status and mechanism of the high criminal courts with special powers governed after abolishing of State Security Courts in accordance with the Articles between 250 and 252 of Criminal Procedure Code numbered 5271 is discussed.Firstly the concept of court is defined and the need for these courts is explained chronologically, the legal status and importanceof these courts within the Turkish judiciary is introduced with the equal examples in foreign countries. The issues concerning the principle of ex officio judge of these courts, their feature of being specilized court and whether they are extraordinary judicial authority is analyzed and the compability of these courts to the law is assessed.The jurisdiction of the these courts with special powers is analyzed in respect to the jurisdiction in venue and jurisdiction on subject matter, organization fact which determines the jurisdiction and the concept of organizational crime is discussed with its supra-national dimension and their equals on foreign countries. The problems encountered on the application of the subject matter and disputable issues are included. The judicial process in these courts in three parts such as investigation process, prosecution process and legal remedy process is compared with the regulations on the period of State Security Court and the deficiencies, failures and the mistakes on the application are defined and explained.Key words: Court, Court with Special Powers, State Security Court, Legal Status, Turkish Judiciary, Organization, Organizational Offence
