| dc.description.abstract | 4721 sayılı Türk Medeni Kanununda aslolan velayet kurumudur. Vesayet müessesesi, velayet müessesesi karşısında istisnai bir kurumdur. Nitekim vesayet, velayet altına alınmayan küçük ve kısıtlıların korunması için getirilmiştir. Vesayet, Türk Medeni Kanununda sınırlı sayıda düzenlenen kısıtlama sebeplerinin varlığı halinde uygulanır. Vesayet müessesi ile koruma altına alınan kimse için vasi önemli yer tutmaktadır. | dc.description.abstract | The custody institution is the main one in the Turkish Civil Code no. 4721. The guardianship institution is an exceptional institution against the guardianship institution. As a matter of fact, guardianship was brought for the protection of small and restricted people who were not taken under custody.Guardianship is applied in the presence of restriction reasons regulated in the cases described in Turkish Civil Code. The guardian has an important place for anyone who is under protection with a guardianship institution. In our study, besides the theoretical information about guardianship, problems in practice will also be addressed.Key Words: Family Law, Guardianship, Legal Guardian | en_US |
