Hukuk düşüncesinde hakkaniyet kavramının tarihi ve felsefi temelleri

Abstract

İnsanlık tarihi boyunca var olan ile ideal olan arasındaki mesafenin her alanda azalması için birtakım arayışlar içine girilmiştir. Gerçeklik, var olan imkan ve ihtimallerin sınırlılığında şekillenmiştir. İdeal olan ise bu sınırlılığı daha iyiye doğru götürme çabasıdır. Hukuk alanında da kanun koyucular, gerçeklik boyutunda mevcut olan imkan ve ihtimallerin sınırlılığında birtakım kanunlar vazetmişlerdir. Kanun koyucunun hayata dair bütün ihtimalleri hesaplaması tabiatıyla mümkün olmamıştır. Bu anlamda kanun metni çıkışı itibariyle birtakım genellikler ve katılıklarla maluldür. Kanunun genelliği ve katılığı ise adalet talebinin karşılanmasında güç durumların ortaya çıkmasına sebep olmuştur. Zira realitedeki detaylara hukuk metninin ayniyle cevap vermesi mümkün değildir. Adalet ihtiyacını karşılamak ve ideal olana daha yakın olmak için bazı kavramlara ihtiyaç duyulmuştur. Bu kavramlardan biri de hakkaniyettir.Hakkaniyet, bu anlamda genellikten ve katılıktan ötürü hukuk metninde meydana gelen eksikliklerin tashih edilmesi, tamamlanması ve yumuşatılması eylemidir. Bu eylem sayesinde pozitif hukuk, daha esnek hareket ederek adalet talebine daha iyi cevap verecektir. Tezimizde, hakkaniyetin kavramsal olarak neye tekabül ettiği, yakın kavramlarla ne tür münasebetler içinde olduğu, tarihi bağlamda nerede yer aldığı ve ne tür işlevler gördüğü incelenmektedir.

Throughout the history of humanity, some searches have been made to reduce the distance between the existing and the ideal in every field. Reality is shaped by the limitations of existing possibility and probabilities. Ideally, it is an effort to improve this limitation. In the field of law, too, legislators have also enacted some laws within the limitations of the possibility and probabilities available in the dimension of reality. Naturally, it was not possible for the legislator to calculate all the possibilities regarding life. In this sense, the text of the law has some suffered generalities and rigidities as of its origin. The generality and rigidity of the law, on the other hand, led to the emergence of difficult situations in meeting the demand for justice. Because it is not possible for the legal text to respond to the details in reality in kind. Some concepts were needed to meet the need for justice and to be closer to the ideal. One of these concepts is equity. In this sense, equity is the act of correcting, completing and softening the deficiencies in the legal text due to its generality and rigidity. Thanks to this action, positive law will act more flexibly and respond better to the demand for justice. In our thesis, what the concept of equity corresponds to, what kind of relations it has with close concepts, where it takes place in the historical context and what kind of functions it performs are examined.
