İslam hukukunda adil yargılama esasları

Abstract

Bu tezin amacı, âdil yargılamanın gerektirdiği prensiplerin, İslam hukuk sistemindeki karşılığını bulmak ve bu sistemde yer alan adalet ilkelerinin yeterliğini saptamaktır. Bu amaç doğrultusunda, çalışmanın ilk bölümünde, yargı ve adalet ile ilgili tanımlamalara yer verilmiş, devleti oluşturan yasa, yönetim ve yargı gibi temel unsurların adalet ile olan yakın ilişkisi ele alınarak incelenmiştir; ikinci bölümde, âdil yargılamanın esasını oluşturan temel ilkelerin ve âdil yargılamayı engelleyen faktörlerin tespitine yer verilmiştir. Hukuk devletini meydana getiren temel ilkelerin başında âdil yargılama ilkesi gelmektedir. Herkes, kanunla yetkilendirilmiş mahkemelerde bağımsız, tarafsız ve hakkaniyete uygun bir şekilde yargılanma hakkına sahiptir. Yargı makamları ise, yargılamanın bütün aşamalarında taraf tutmaksızın, her türlü iç ve dış etkenlerden bağımsız hareket etmekle yükümlüdür. Tezimizde, İslam hukuk sisteminde adaletin hassas terazilerle ölçülmek suretiyle mahkemelerde uygulandığı, yargı karşısında her türlü yetkinin ve gücün etkisiz olduğu saptanmıştır. Bu bağlamda İslam hukuk teorisinin, insan hakları düzleminde âdil yargılamayı sağlayıcı türden pek çok ilkeye sahip olduğu, ancak pratikte yargısal adalet mekanizmalarının fonksiyonel bir şekilde işletilememesinden kaynaklanan eksikliklerin İslam'ın adalet imajını zedelediği anlaşılmaktadır.

The aim of this thesis is to find the equivalent of the principles required by fair trial in the Islamic legal system and to determine the adequacy of the principles of justice in this system. For this purpose, in the first part of the study, the definitions related to the judiciary and justice are included, and the close relationship of the basic elements that make up the state, such as law, administration and judiciary, with justice; In the second part, the determination of the basic principles that form the basis of fair trial and the factors that prevent fair trial are given.The principle of fair trial is at the forefront of the basic principles that constitute the state of law. Everyone has the right to an independent, impartial and fair trial in courts authorized by law. Judicial authorities, on the other hand, are obliged to act independently of all kinds of internal and external factors, without taking sides at all stages of the proceedings. In our thesis, it has been determined that in the Islamic legal system, justice is practiced in courts by being measured with sensitive scales, and that all kinds of authority and power are ineffective against the judiciary. In this context, it is understood that Islamic legal theory has many principles that ensure a fair trial on the level of human rights, but in practice, the deficiencies arising from the inability to operate judicial justice mechanisms in a functional way damage the image of justice in Islam.
