dc.description.abstract | Bu çalışmanın amacı, 4857 sayılı İş Kanunu uyarınca işçinin iş sözleşmesini haklı nedenle feshini, öncelikle iş sözleşmesinin sona erme hallerini inceleyerek, fesih türlerinin hukuki niteliklerini açıklamak, fesih türleri arasındaki benzerlikleri ve farklılıkları, ayrıca haklı neden kavramı, 4857 sayılı İş Kanunu'ndaki haklı nedene ilişkin düzenlemeleri de göz önünde bulundurarak anlatmaktır.Bu çalışmada, öncelikle iş sözleşmesinin sona erme halleri, haklı neden kavramı, 4857 sayılı İş Kanunu yer alan düzenlemeler ve sonuçları ele alınmış ve benzer durumlara ilişkin verilmiş Yargıtay Kararları tartışılarak haklı neden kavramı ve hukuki düzenlemelerinin somut olaya göre değerlendirmesi yapılmıştır. | |
dc.description.abstract | The purpose of this study is, to explain the termination of the employee's employment contract by the just cause in accordance with Labor Law No. 4857. We will firstly examine the legal qualities of the types of termination of the employment contract, the similarities and differences between the types of termination and the concept of justified termination.Termination of employment contract by the just cause is the termination of the contract if the contract of the parties to the order of honesty becomes impossible. The legal condition is that there is a justifiable reason for the right of termination to be exercised. Termination right of the employement contract for the just cause by employee is important, especially since the reasons for justifiable termination which constitute the subject of the study include differences in practice and regulations.In this study, firstly the concept of termination of employment contract, the concept of justified cause, theregulations and the results of Labor Law No. 4857 discussed and the final judgements of the Supreme Court on similar cases, legal arrangements and cause of termination according to the concretecase evaluated. | en_US |
