Rekabet hukuku açısından teşebbüs birliği davranışları

Abstract

Bu çalışmanın amacı, teşebbüs birliklerinin Rekabet Hukuku açısından oynadığı önemli rollerin araştırılması, rekabet uygulamaları doğrultusunda teşebbüs birliklerinin rekabeti ihlal eden çeşitli kararları ve eylemleri yoluyla meydana getirdikleri rekabet ihlallerinin incelenmesi, çeşitli Rekabet Kurulu ve yargı kararları ışığı altında değerlendirilmesidir. Buna göre, bu ihlallerin ekonomik hayatta meydana getirdiği olumsuz etkilerin ve rekabet kanunu ihlallerin önlenmesine yönelik dikkat edilmesi gereken hususların ortaya konması hedeflenmektir. Rekabeti ihlal eden teşebbüs birliği davranışlarının hukuki ve ekonomik sonuçlarının irdelendiği çalışma; teşebbüs ve teşebbüs birliği kavramı ve türleri tanımlanarak, faaliyet ve amaç bakımından, dernek, vakıf, sendika, kooperatif gibi benzer kurumlarla karşılaştırılmıştır. Rekabet hukuku bağlamında teşebbüs birliği kararları ile rekabet ihlaline sebebiyet veren teşebbüs birliği kararlarına bağlanan yaptırımların da araştırma kapsamına alınmıştır. Rekabeti ihlal eden teşebbüs birliği uygulamaları ve buna bağlı ihlallerin meydana getirdiği olumsuz etkiler detaylı bir şekilde açıklanarak, çeşitli yargı kararları, Rekabet Kurulu kararları, doktrindeki çeşitli görüşlerle araştırma desteklenmiş, geniş bir perspektifle sebep-sonuç ilişkisi içinde incelenerek açıklanmıştır.

The purpose of this study is to research the significant roles played by associations of undertakings in terms of Competition Law, and to examine the breaches of competition committed by associations of undertakings through various different decisions and acts of them breaching the competition within the frame of competition practices, and to assess and discuss the subject in the light of various decisions of Competition Board and court judgments in connection therewith. Accordingly, it is aimed to reveal the negative effects made by these breaches in economic life and the points to consider for prevention of breaches of competition law. In this study scrutinizing the legal and economic consequences of behaviors of associations of undertakings breaching the competition, first, undertaking and association of undertakings concepts and types are defined, and then, they are compared to similar other organizations such as associations, foundations, unions and cooperatives in terms of activities and objectives. Also included in the scope of this study are the decisions of associations of undertakings within the context of competition law and the sanctions imposed on the decisions of associations of undertakings breaching the competition. Practices of associations of undertakings breaching the competition and the associated negative effects caused by these breaches are described in details, and the study is supported by various court judgments, decisions of the Competition Board, and various different opinions defended in the doctrine, and the subject matter is examined and described within causal relations and from a wide perspective.
