İslâm Hukukunda yemin ve keffâreti

Abstract

Bu çalışmamızda yemin ve kefâretin; önemi, fonksiyonu konusunda Fıkıh Mezheblerinin görüşlerini, bunların mukayesesini ve değerlendirilmesini göz önünde bulundurarak araştırmaya çalıştık.Çalışmamız girişten sonra, iki bölümden oluşmaktadır. Birinci bölümde; yeminin manaları, şartları, rükünleri, çeşitleri, Allah adına yemin etme ve yemin bozma gibi hususlar ve ayrıca dört mezhebin görüşleri ve hükümleri yer almaktadır.İkinci bölümde; kefâret ile ilgili konuları inceledik. Yemin kefâreti, oruç bozma kefâreti, hac kefâreti, öldürme kefâreti ve zıhar kefâreti gibi konulara açıklık getirmeye çalıştık. Bu konuların üzerine dört mezhebin görüşlerini getirmeyi de ihmal etmedik.

In this study we tried to examine the views of Fiqh?s denominations about the importance and function of oath and redemption by having in mind their comparation and evaluations.The study is formed by two chapters after the introduction. In the first chapter there are subjects such as meanings, conditions, bowings and sorts of oath; swear in the name of Allah and violate an oath. Beside these, there are the views and provisions of four mazhabs.In the second chapter we analyzed themes such as meaning, importance and benefit of redemption. And we tried to explain the redemption of oath, fasting, Hajj, killing and Zihar. We didn not forget to add the views of four mazhabs about these themes too.
