Yeni kurumsalcılık çerçevesinde Enerji Topluluğu

Abstract

Enerjinin Avrupalılaşması arz güvenliği, rekabet ve sürdürülebilirlik olmak üzere üç kriter etrafında şekillenmektedir. Bu çalışma Avrupa Birliği'nin gündeminde giderek daha çok yer işgal eden enerjinin Avrupalılaşmasının ve bu çerçevede Birlik ile Güneydoğu Avrupa ülkeleri arasında 2006 yılında oluşturulan Enerji Topluluğu'nun kurumsal yapısı, işleyişi ve etkinliğinin Yeni Kurumsalcılık bağlamında ne derece açıklanabildiğini değerlendirmektedir.Kurumsal yapısı itibarıyla Birliğin bölgedeki bir adaptasyonu durumundaki Topluluğun ortaya çıkışı konusunda Yeni Kurumsalcılığın bir alt türü olan Rasyonel Tercihli Kurumsalcılık yeterli açıklama sunabilmekteyken; diğer bir Yeni Kurumsalcılık türü olan Tarihsel Kurumsalcılık Topluluğun gelişimi ve bundan sonraki yönelimi hakkında öngörüde bulunmayı mümkün kılmaktadır. Daha çok kimlik, değer ve normların şekillenmesine inşacı bir perspektif sunan Sosyolojik Kurumsalcılık bu çalışmanın kapsamı dışında tutulmuştur. Çalışmanın örnek olayı olan Enerji Topluluğu'ndaki mevcut uygulama eksiklikleri Yeni Kurumsalcılığın kurumların etki doğurduğu yönündeki temel savını zayıflatır bir nitelik arz etse de bölge ülkelerinin hepsi için aynı şeyi söylemek mümkün değildir. Çalışma, Topluluğun yaptırım mekanizmasının daha etkili hale getirilmesi amacıyla oluşturulmak istenen ABAD benzeri bir ulus üstü yargı organının teşkil edilmesinin söz konusu kurumsal oluşumun etkinliğini artıracağı ve bölge ülkeleri için niyetlenilmemiş sonuçların söz konusu olacağı sonucuna varmıştır.Anahtar kelimeler: AB Enerji Politikası, Güneydoğu Avrupa, Enerji Topluluğu, Enerjinin Avrupalılaşması, Yeni Kurumsalcılık.

Europeanization of energy shapes around three criteria, namely supply security, competition and sustainability. This study seeks to explore europeanization of energy which is attributed more and more importance in European Union's agenda and the explaining capability of New Institutionalism for the Energy Community's institutional structure, functionality and effectiveness, which was established between the Union and South East European countries in 2006.While Rational Choice Institutionalism, a sub-category branch of New Institutionalism, can adequately explain the emergence of the Energy Community, which is an adaptation of the Union in its structural terms, the other sub-branch of New Institutionalism, Historical Institutionalism makes it possible to understand the progress in question and to foresee the Community's future. The last sub-branch of New Institutionalism, Sociological Institutionalism focusing on shaping values and norms of the actors creating the institutions and presenting a constructivist perspective is not employed within the scope of this study.While the current implementation drawbacks within the case study of Energy Community undermines the core argument of the New Institutionalism that is institutions does matter, it is not possible to say the same thing for the all countries in the region. This study suggests that the formation of a supranational judicial organ like ECJ for the Energy Community, which is tried to enhance its enforcement mechanism, will enhance its effectiveness and there will be unintended consequences in question for the countries in the region.Keywords: EU Energy Policy, South East Europe, Energy Community, Europeanization of Energy, Neo-Institutionalism.
