dc.description.abstractDünyada 1990'lı yılların en büyük özelliği global ticaretin hızla büyümesi, rekabetin artması, ve iletişim teknolojisinin gelişmesi olmuştur. Birbirine bağlı olan bu gelişmeler, fikri mülkiyet haklarına eskisinden daha da büyük bir önem kazandırmış ve global döneme ayak uydurmayı amaçlayan tüm ülkelerde bu konudaki yasal düzenlemelerin yeniden gözden geçirilmesi söz konusu olmuştur. Türkiye de, birçok ülke gibi, ithal ikamesine ve bunu denetlemeye yönelik yardım paketlerine dayalı kalkınma modelini reddederek yatırıma ve ticarete açılmaya karar vermiş ve globalleşen dünyada bir yer edinmeyi hedeflemiştir. 1995 yılında yürürlüğe konan yeni patent, markalar, endüstriyel tasarım ve menşe işaretleri kanunları da Türkiye'nin bu karan vermesini takip eden gelişmelerdir. Türkiye'de gözlenen bu gelişmelerde Avrupa Birliği ile yapılan Gümrük Birliği Anlaşması' nın önemi büyüktür, ancak globalleşme sürecine giren dünyada yer almak isteyen Türkiye'nin, Fikri ve Sınai Haklar konusuna getirdiği gelişmeler olmaksızın global dünyaya ayak uyduramayacağım bilmesi de bu gelişmelerde çok önemli rol oynayan bir nokta olmuştur. Gümrük Birliği aşamasında Fikri ve sınai Haklar konusunda gözlenen gelişmeler, Markalar üzerinde de olumlu etkilere yol açmış ve Türkiye'deki girişimcileri yakından ilgilendiren bu konu üzerinde önemli bir şekilde durulmuştur.uı Gümrük Birliği Anlaşmasına karşın Türkiye'nin `Hakkın Tüketilmesi İlkesf'nden yararlanamaması ise hala bir soru işareti olmaya devam etmekte ve Avrupa Birliği'nin benimsediği `Malların Serbest Dolaşımı` ilkesine ters düşmektedir.
dc.description.abstractThis paper aims to make the concept of Intellectual Property clearer in the reader's mind, to give extensive information on `Trademark` which is regarded as a very important part of the system, to give the impacts of the `Exhaustion of Rights Principle` which still causes some confusion in the European Union and to connect the improvements made in these areas to the situation in Turkey regarding the Customs Union established with Europe. The concept of `Globalization` and its impacts on the European Union is discussed in detail in the first chapter. The notion of International Trade, increased competition, and the growing importance of Intellectual Property Rights as a consequence of these developments are also briefly mentioned. In Chapter 2; detailed information is given on the Intellectual Property Rights and the historical evolution of this concept At this point, special emphasis is given to the TRIPs Agreement and its effects on the law of Intellectual Property. Policies of the European Union such as the `Competition policy` and the concept of `Unfair Competition` is also introduced to the reader in order to state the importance and the necessity of the new laws in the field of Intellectual Property.In Chapter 3; information is given on the `Trademark` system of the Union which has crucial importance when Intellectual Property is concerned. In Chapter 4; The formation of the Internal Market and its effects on the Trademark system is discussed. The concept of `Community Trademark` which, in many ways, brings a new dimension to the system, is introduced to the reader. At this point, the functioning of the Office of Harmonization in the Internal Market (OHIM) is described in great detail. As developments such as the creation of the `Community Trademark` and the establishment of OHIM are made clear in the reader's mind; the `Exhaustion of Rights` Principle, which still causes confusion within the Union despite all the improvements achieved in the field of Intellectual Property Rights, is introduced to the reader in Chapter 5. Chapter5 aims to clarify the meaning of `Exhaustion of Rights Principle` and `Parallel Imports` which have close ties with exhaustion. In this Chapter concepts like `The Free Movement of Goods`, `Competition`, and `Harmonization of Trademarks` are also discussed as in relation to the exhaustion principle.VI Chapter 6; defines the exhaustion principle in scope of the Customs Union Agreement between Turkey and EU. In this Chapter, the meaning of `Customs Union` and its effects on Turkey and the EU are clarified. Intellectual Property Protection in Turkey, and Trademarks in particular, are also discussed in the scope of Customs Union in this Chapter. Reasons beyond the exclusion of Turkey from the `Exhaustion of rights` Principle regardless of its Customs Union Agreement with Europe constitutes the last phase of this chapter.en_US
