dc.description.abstractHukuk sistemimizde aile hukukundan dogan dava ve isleri görmek üzere özel birmahkeme olan aile mahkemeleri kurulmustur. Yargıtay, Aile Mahkemesi Kanunu'nun2. ve 4. maddeleri ile Hâkimler ve Savcılar Yüksek Kurulu'nun 8.7.2003 günlüyetkilendirmeye iliskin kararını dikkate alarak, 8.7.2003 tarihini aile mahkemelerininfaaliyete geçis tarihi olarak belirlemistir. Aile Mahkemeleri Kanunu ile ailemahkemelerinin kurulus, görev ve yargılama usulleri düzenlenmistir.Özel mahkeme olan aile mahkemelerine atanacak hâkimlerden özel nitelikleraranmıstır. Hâkimler, atanacakları bölgeye veya bir alt bölgeye hak kazanmıs, adliyargıda görevli, tercihen evli ve çocuk sahibi, otuz yasını doldurmus ve aile hukukualanında lisansüstü egitim yapmıs olmalıdır. Bunun yanında aile mahkemeleribünyesinde birer psikolog, pedagog ve sosyal çalısmacı bulunacaktır.Aile mahkemeleri Türk Medenî Kanunu'nun üçüncü kısmı hariç olmak üzereikinci kitabından ve Türk Medenî Kanunu'nun Yürürlügü ve Uygulama Sekli HakkındaKanuna göre aile hukukundan dogan dava ve islerde görevlidirler. Ayrıca MilletlerarasıÖzel Hukuk ve Usul Hukuku Hakkında Kanuna göre aile hukukuna iliskin yabancımahkeme kararlarının tanıma ve tenfizine iliskin dava ve islerde de görevlidirler.Bunun yanında aile mahkemeleri kanunlarla verilen diger dava ve islerde degörevli kılınmıslardır.Çalısmamızın birinci bölümde, aile mahkemelerinin hukuki yapısı, ikincibölümünde görev, yetki ve taraflar, üçüncü bölümde yargılama usulü, dördüncübölümde kanun yolları incelenmistir. Ayrıca aile mahkemelerinin sayısı ve kurulduguiller bakımından bilgiler sunulmustur.
dc.description.abstractIn our law system, special family courts have been established to follow thelawsuits and legal proceedings resulting from the family law. The Supreme Courtdetermined the date of 8.7.2003 as operation date of family courts by consideringArticles 2 and 4 of the Family Court Law and 8.7.2003 dated resolution of the HighCouncil of Judges and Attorneys on authorization. With the Family Courts Law,establishment and duties of family courts and their judging procedures are determined.Special qualifications are required for judges who will be appointed to thefamily courts that are special courts. Judges must gain right for the region or sub-regionthey will be appointed to, be judicially employed, preferably are married and have achild, at their full 30 years age and have a master degree in family law field. Besides, apsychologist, pedagogue and social official shall be employed under structure of familycourts.The family courts are in charge of lawsuits and legal proceedings resulting fromthe second book of the Turkish Civil Law except the third section and from the familylaw pursuant to the Law on Application Type and Enforceability of the Turkish CivilCode. Besides, the family courts are in charge of lawsuits and legal proceedings relatedto recognition and enforcement of foreign court decrees related to the family lawaccording to the International Private Code and Act on Procedural Law.In addition to the above, family courts are also in charge with other lawsuits andlegal proceedings permitted under laws.Unless a peace is obtained, judging is continued and a decision is made on thecase. Provided that provisions of private laws shall be reserved, for legal matters thatare not involved in the Family Court Law, procedural provisions related to family lawof the Turkish Civil Code and Code of Civil Procedure Courts shall apply.In the first section of our study, the legal structure of family courts, in the secondsection, duties, powers and parties, in the third section, judging procedures, and in thefourth section, legal ways are examined. Besides, information about the number offamily courts and the cities they are established are given.en_US
