Türkiye`de iş kazalarında iş sağlığı ve güvenliğinin incelenmesi

Abstract

İnsanlık tarihi boyunca insanlar her zaman bir işle uğraşmışlardır. İlk dönemlerde yaşamlarını sürdürebilmek için çalışan insanoğlu, nüfus artışı ve bilimdeki gelişmeler, devlet sisteminin ortaya çıkmasına neden olmuştur. Bu durum da çalışma hayatı farklılaştırmış ve yeni çalışma alanları ortaya çıkmasına neden olmuştur. Her alanda olduğu gibi devlet sistemi çalışma hayatında da düzenlemeler yaparak çalışanların haklarını korumaya çalışmıştır.Kamu kurumları her alanda olduğu gibi çalışma hayatındaki düzenlemelerin işlemesini sağlamaya çalışmaktadır. Kurumlar bu alandaki denetim yetkisini kullanarak çalışma hayatındaki aksaklıkları önlemekte ve mevzuat hükümlerinin uygulanmasını sağlamaktadır.İş kazaları da çalışma hayatındaki düzenlemelere uyulmaması sonucu ortaya çıkan istenmeyen durumlardır. Bu nedenle yetkili kamu kurumlarının denetim birimleri bu olayları araştırıp, nedenleriyle birlikte olayı ortaya koymakta ve bu konuda kimlerin kusurlu olduklarını iş sağlığı ve güvenliği hükümleri çerçevesinde ortaya çıkarmaktadır.Çalışma hayatında önem arz eden kavramlara bu çalışmamızda yer verilmiştir. İş kazası olduktan sonra yapılması gerekenler anlatılarak bu konuda denetime yetkili birimlerden bahsedilmiştir. Bu konuda yetkili olan Sosyal Güvenlik Kurumu'nun denetim biriminin iş kazası inceleme süreci anlatılmıştır. Denetim sonucunda düzenlenen raporlar incelenerek iş kazası geçirenin yaşı, medeni durumu, iş kazasının meydana geldiği işkolu, kazaya neden olanların kaza olayında iş sağlığı ve güvenliği mevzuatına uymamaları nedeniyle ne kadar kusurlu oldukları, kaza olayının ölümlü veya yaralanmalı olması durumu, yaralanmalı ise meslekte kazanma gücü kaybı oranın ne olduğunu içeren bilgiler temin edilmiştir.Bu bilgiler ışığında değerlendirmeler yapılarak denetimin iş kazalarının önlenmesi ve iş sağlığı ve güvenliği hükümlerinin işyerlerinde yerleşmesinin üzerinde değerlendirmelere yer verilmiştir.

Throughout the history of humanity, people have always been engaged in an occupation. Working for struggling to survive in the early years, humankind has provide the emergence of the state system with population growth and future developments. This situation has differentiated the working life and has caused the emergence of new fields of work.Just like every other area, the state system has also tried to protect employees' rights by making regulations in working life. State institutions try to ensure the process of regulations in the working life as it is in every area. By using supervisory authority in this area, Institutions prevent the malfunctions in the working life and ensure the application of legislation provisions.Occupational accidents are undesirable situations that result in the failure to comply with regulations in the working life. For this reason, the supervisory units of the competent state institutions disclose the case together with the reasons by investigating these incidents and they reveal that who are deficient in this matter within the framework of the occupational health and safety provisions.The concepts which have important role in working life are mentioned in this study. Explaining that what can be done after the occupational accident that has occurred, it is also mentioned the authorized units with regards to the case. Occupational accidents` investigation process made by the authorized supervisory unit of Social Security Institution has been explained. Analyzing the report regarding the investigation, it is provided how the worker's age, marital status, business line where the accident happened, deficiency to which extent the lack of complying with the legislation provisions of occupational health and safety for the responsibility, whether the case is mortal or injured, and if it is injured; the rate of loss towards the improvement in the profession.Assessing with reference to these instructions, evaluation is indicated the supervision for prevention of occupational accidents and enhancement the provisions of legislation for occupational health and safety in the workplaces.Key words: occupational health and safety, occupational accident, working life, supervisory unit
