Tanzimat Dönemi modern belediye örgütünün kuruluşu

Abstract

ÖZET Türkiye'de modern belediye örgütünün kurulması, 1854 yılında İstanbul Şehremaneti'nin kuruluşundan, 1930 yılı 1580 sayılı Belediye Kanunu'nun yürürlüğe girmesine değin uzanan bir süreçte gerçekleşmiştir. Çalışmamızda kuruluştan I. Meşrutiyet' e kadar olan dönemi ele aldık. Yeniçeri Ocağının kapatılması sonucu beledi fonksiyonlarını yitiren kadılık kurumunun yerine İstanbul'da İhtisab Nazırlığı, vilayetlerde ise İhtisab Müdürlükleri kuruldu. Klasik dönem kadılık sistemini ve belediye örgütünün kurulmasına kadar geçen ara dönemi I. Bölümde ele aldık. II. Bölümde modern belediye örgütünün kurulmasını gerektiren temel nedenleri ele aldık. Beledi hizmetlerin yerine getirilmesinde İhtisab Nazırlığı da yetersiz kalınca 18 Ağustos 1854 tarihli bir resmi tebliğ ile İstanbul Şehremaneti kuruldu. Bunu 9 Mayıs 1855 tarihinde İntizam-ı Şehir Komisyonu'nun kuruluşu ve bu komisyonun hazırladığı rapor doğrultusunda İstanbul'un ondört belediye dairesine ayrılması izledi.Öngörülen ondört belediye dairesinden, örnek olarak ilk açılanı olan, Galata-Beyoğlu Altıncı Daire-i Belediyesini ve taşradaki belediye örgütlerinin kuruluşunu III. Bölümde ele aldık. IV. ve son bölümde, kurulan belediye örgütlerinin yasal dayanağını oluşturan temel nitelikteki nizamname ve talimatnameleri ele aldık. Ekler bölümünde bu temel metinleri vererek çalışmamızı sona erdirdik.

ABSTRACT The history of modem municipality oigamsations in Turkey, has a long historical course from the establishment of Mtmicipality of Istanbul in 1854 till to the Law of Municipality, which bad entered into force in 1930. In our thesis we have observed the period from its beginning (establishment) to the Constitutional Monarchy, the first. After the abolishment of Janissary CfBps, la place of administrative district of cadi system, which had lost its masidpaî HairchMSj Ministry of Ihtisab in Istanbul and General Directories of IMisab was established. Besides, we have examined ; classic period of administrative district of cadi and the period till to the establishment of ıroîöîcipality organisation in Chapter I. In the second Chapter, we have examined the basic reasons» which have implicated the establishment of modem aumcipality organisations. Due to the insufficiency of Ministry of îhtisab for both the municipal works and duties, with an Official legislation dated August 18, 1854, Municipality of Istanbul was «stabKsbed. And the set up of the Commission of City Order in May 9, ÎS55 mâ 4m to the report of this Commission, the division of İstanbul into 14 nsiskipafity units, followed it. Among these 14 municipalities forecasted, as an example we studied in Chapter-I, the first one, Galata-Beyogtti, mih Municipality Chamber and the establishment of Municipality Organisations in the provinces. In the IV and in the last Chapter, we Imve studied the basic Regulations & Directives, forming the legal basis of established municipality organisations. In the Appendix, we gave an end to our study with these basic texts.
