Abstract

Mala zarar verme suçu, günlük hayatta en çok işlenen suç tiplerinden biridir. Bu suç,5237 sayılı TCK'nun malvarlığına karşı suçlar başlıklı bölümünde mala zarar vermebaşlığı altındaki 151 ve 152. maddelerinde düzenlenmiştir.Mala zarar verme fiilleri, mülkiyet kavramı ve bireysel menfaatlerin ortaya çıktığı çokeski tarihi dönemlerden günümüze kadar varlığını sürdürse de bu fiiller ancak yakınzamanlarda bağımsız bir suç haline getirilmiştir.Tezimiz, Türk Ceza Kanunu'nun mala zarar verme suçları ile ilgili düzenlemeleriniaraştırıp değerlendirmek amacı ile hazırlanmıştır. Tez hazırlanırken başta Türk CezaHukuku Külliyatı olmak üzere birçok kitap, tez, dergi, makale ve web sayfalarındanistifade edilmiştir.Tezimizde, tartışmalı konularla ilgili öğretideki değişik görüşlere yer verilmiş ve içtihatve uygulamalarla bu konular açıklanmaya çalışılmıştır. Yasa metni, öğretideki görüşlerve içtihatlar çerçevesinde mala zarar verme suçuna ilişkin karşılaşılabilecek sorunlarüzerinde durulmuş ve bu sorunların ne şekilde çözüme kavuşturulması gerektiği elealınmıştır.Mala zarar verme suçunu inceleyen bu teze, suçun tarihsel gelişimini de kapsayan temelkavramların irdelenmesi ile başlanmıştır. İkinci bölümde suçun unsurları ve niteliklihalleri ele alınmıştır. Üçüncü bölümde ise kusurluluk ve kusurluluğu etkileyen haller,etkin pişmanlık, şahsi cezasızlık veya cezada indirim yapılmasını gerektiren şahsisebepler, suçun özel görünüş şekilleri, benzer suç tiplerinden farkı, soruşturma vekovuşturma usulleri ve yaptırım hususları ele alınarak çalışma sonlandırılmıştır.
