1961 ve 1982 Anayasalarına göre sosyal hukuk devleti

Abstract

Bu çalısmanın amacı, Sosyal Hukuk Devleti anlayısının evrensellesmiszorunlulukları çerçevesinde; Türkiye'de 1961 ve 1982 Anayasalarına göre SosyalHukuk Devleti Anlayısını ve uygulamalarını ortaya koymaktır. Çalısmamızda hukukdevletinin tanımı, tarihsel gelisimi ve gereklerinin ne oldugu; Hukuk DevletindenSosyal Hukuk Devletine geçis, Sosyal Hukuk Devletinin tanımı, tarihsel gelisimi,gerekleri, Türkiye'deki gelisimi, 1961 ve 1982 Anayasalarında Sosyal Hukuk Devletiile ilgili yer alan maddeler, Türkiye'deki Sosyal Devlet uygulamaları ve AnayasaMahkemesi'nin Sosyal Hukuk Devleti ile ilgili vermis oldugu kararlar üzerindedurulmustur.Çalısmamız, toplam üç bölümden olusmustur. Birinci bölüm ?Giris?bölümüdür.kinci bölümde, ?Kuramsal Temeller ve lgili Literatür? baslıgı altında altıkısım bulunmaktadır. Birinci kısım Hukuk Devletinin tanımı ögeleri, biçimleri vetarihsel olarak gelisimine iliskin bilgilere yer verilmistir. kinci kısımda, Sosyalhukuk devletinin tanımı, unsurları, biçimleri ve tarihsel olarak gelisimine iliskinbilgilere yer verilmistir. Üçüncü kısımda, Sosyal hukuk Devleti ile ilgili 1961Anayasası'nda yer alan maddelerin dökümü yapılmıstır. The aim of this study is to put forward the understanding and applications ofSocial State Governed by the Rule of Law in Turkey, as regards to 1961 and 1982constitutions, in respect to the universal requirements of the concept ?Social StateGoverned by the Rule of Law?. In our study, we pointed out the definition, historicaldevelopment and requirements of the Rule of Law State, transition from Rule of LawState to Social State Governed by the Rule of Law, the definition, historicaldevelopment and requirements of the Social State Governed by the Rule of Law, itsdevelopment in Turkey, the acts which are to be found in 1961 and 1982constitutions related to Social State Governed by the Rule of Law, the applications ofSocial State in Turkey and the verdicts of the Supreme Court related to the SocialState Governed by the Rule of Law.The study consists of three parts. The first one is ?Introduction?. In thesecond part, there are six sections under the title of ?Institutional Bases and RelevantLiterature?. In the first section, the definition, elements, forms and historicaldevelopment of Rule of Law State are pointed out. In the second section, thedefinition, elements, forms and historical development of The Social State Governedby the Rule of Law are stated. In the third section, the acts related to the Social StateGoverned by the Rule of Law in 1961 Constitution are given. In the fourth section,ivthe acts related to the Social State Governed by the Rule of Law in 1982 Constitutionare given. The applications of Social State Governed by the Rule of Law in Turkeyare expressed in the in the fifth section. In the sixth section the verdicts of theSupreme Court related to the Social State Governed by the Rule of Law areindicated. Finally, the third part consists of the interpretations of the acquired dataand the results section.Key Words: Rule of Law State, Social State Governed by the Rule of Law
