İdari vesayet ve köy yönetimi

Abstract

Köy idareleri, bir mahalli idare birimi niteliğindedir. 1982 Anayasası mahalli idareleri 127.maddesinde; il, belediye ve köy halkının mahalli müşterek ihtiyaçlarını karşılamak üzere düzenlenen mahalli idare birimleri arasında köy idareleri de sayılmış ve en üst hiyerarşik norm olan anayasada, köylerin açıkça bir yerel yönetim birimi olduğu ifade edilmiştir. Köy idarelerin bir mahalli idare birimi olması onların devlet tüzel kişiliği dışında ayrı bir tüzel kişiliğe sahip olmalarını da beraberinde getirmektedir. Böylece köy idarelerinin kendilerine haiz özerklikleri, bütçeleri, personeli bulunmaktadır.Her ne kadar anayasada köyler bir mahalli idare birimi olarak düzenlenmiş olsa da mahalli idareler için idarenin bütünlüğü ilkesi gereğince ön görülen idari vesayet denetimi, köyler üzerinde daha belirgin bir şekilde uygulanmaktadır. İdari vesayet ise kavramsal olarak, devlet tüzel kişiliği dışında bulunan kamu tüzel kişilerinin merkez tarafından denetlenmesi olup fakat bu denetimin hukuka uygunluk denetimi ile sınırlı tutulduğu bir denetim mekanizmasıdır. Zira köy idarelerini düzenleyen 442 sayılı Köy Kanunu, vesayet makamı olarak düzenlediği mülki idare amirlerine daha geniş vesayet yetkileri vermiştir. Ayrıca, köy tüzel kişiliğinin temsilcisi olan muhtarın da görev ve yetkileri köye ait işler ve devlete ait işler şeklinde düzenlendiğinden muhtarı bir bakımdan devlet memuru olarak telakki etmekte ve bu durum vesayet denetiminin sınırlarını genişletmektedir. Bu tez çalışmasında, devlet teşkilatlanması içinde mahalli idare birimi olarak kabul edilen köy idarelerinin yapısı ve bunlar üzerinde uygulanan idari vesayet yetkisi, bu yetkinin kullanımı, sınırları üzerinde durulmuştur. Ayrıca, idari vesayet konusunda doktrinde mevcut bulunan düşüncelere yer verilmeye çalışılmış, konunun daha somut hale gelebilmesi için çeşitli yargı kararlarına da yer verilmiştir. Köy idareleri hakkında da detaylı açıklamalar yapılmak suretiyle tarihsel gelişiminden, anayasal dönemlerdeki yerinden, köy idarelerini düzenleyen ilgili yasal mevzuattan, köy idarelerinin belirlenen organları ve görevlerinden bahsedilmiştir. Ayrıca, bu çalışmada günümüzün gereksinim ve ihtiyaçlarının tespit edilmesi maksadıyla devlet aygıtının yeniden yapılandırılmasına yönelik olarak yapılan reform çalışmaları ve bu çalışmalar neticesinde hazırlanan raporlardaki teşhis ve saptamalara yer verilmiştir. Yasal düzenlemelere, hükümetler tarafından yapılmaya çalışılan reformlara da değinilerek devlet aygıtının gerekliliklerinin neler olduğu ifade edilmeye çalışılmıştır.
