Profesyonel futbolcu sözleşmesi

Abstract

ÖZET Spor, özellikle futbol, günümüz toplumunda sadece ekonomik ve sosyal alanda değil, iç ve dış politika, turizm, sosyoloji, psikoloji, tıp, kültür ve sanat gibi bir çok alanda etkisini hissettiren bir faaliyettir. Futbolu profesyonel olarak icra eden sporcular, yaptıkları bu faaliyet karşılığında ücret almakta, geçimlerini bu şekilde sağlamaktadır. Kulüpler de futbolculara çalışma imkanı sağlayarak, futbolcuların basanları sayesinde ekonomik ve sosyal bakımdan güç kazanmaktadır. Bir ücret karşılığında ve sözleşme yaptığı kulübe bağlılık içerisinde futbolu profesyonel anlamda icra etmek isteyen futbolcuyla kulüp arasında yapılan sözleşme `Profesyonel Futbolcu Sözleşmesi`dir. Bu sözleşme; hizmet görülmesi, ücret, süreklilik, bağımlılık ve bu unsurlar üzerinde kulüp ve futbolcunun anlaşması unsurlarından oluşur. Kulüp ve futbolcu, bu sözleşmeyle karşılıklı olarak bazı haklara sahip oldukları gibi bazı borçların da altına girerler. Türkiye'de futbol sporunun yürütülmesi Türkiye Futbol Federasyonu tarafından hazırlanan Talimatlarla gerçekleşmektedir; fakat Türkiye Futbol Federasyonu UEFA ve FİFA'nın da üyesi olduğundan, yaptığı Talimatlarda bu örgütlerin aldığı kararları da göz önünde bulundurur. Bu çalışmada, kulüple futbolcu arasında yapılan sözleşme hakkında genel olarak (konusu, kapsamı, tanımı, unsurları, hukukî niteliği, şekli ve süresi, yapılma zamanı, benzer sözleşmelerle karşılaştırılması) bilgi verildikten sonra, sözleşmenin tarafı olarak futbolcu ve kulüp hakkında açıklamalar yapılmış, sözleşmeden doğan haklar ve borçlar ile borca aykırılığın sonuçları, uyuşmazlıkların çözümü, transfer ve sözleşmenin sona ermesi konuları ile sona ermenin sonuçları incelenmiştir.

ABSTRACT In these days, sport, especially football has a great effect not only on social and economic life, but also on domestic and foreign policy, tourism, sociology, psychology, medicine, culture and arts. The professional football players are employed for pay by the football clubs. The clubs gain both economic and social power through this way. The contract made between a professional football player and a football club, to affiliate the player with the club for a certain wage, may be named as 'Professional Football Player Contract'. The elements of this contract are service, wage, continuity, dependence and the mutual agreement between the football club and the player with regard to these elements.The football club and the player will have mutual rights as well as obligations. Football Federation of Turkey regulates the football in Turkey by it's directives. As a member of UEFA and FIFA, Football Federation of Turkey keep the decisions of these organizations in mind while preparing these directives. In this study, we first present the general knowledge related to the contract between a football club and a football player (like the subject, scope, definition, elements, legal characteristic, form, duration, period of the contract and it's comparison with other similar contracts). Then we give detailed information about football clubs and football players as the parties of this contract. And finally, we examine the rights and the obligations of the parties, the results of the breach of the contract, the solution proposals for the conflicts, the transfer and the termination of the contract as well as the results of the termination respectively.
