İslam Hukukunda mefkud ve hükümleri

Abstract

Bu tezimizde, Hanifi mezhebini esas alarak diğer mezhepleri görüşüne de imkân nisbetinde temas ettik. Bununla beraber Türk Medeni Hukuku'ndaki uygulamaya da zaman zaman atıfla bulunduk, mukayeseler yaptık. Çalışmamız bir giriş ve üç bölümden oluşmaktadır. Giriş bölümünde şahıs ve şahsiyet kavramları üzerinde durduk. Ayrıca günümüzde mer'i olan Türk Medeni Hukuk ndaki uygulamaya da yer verdik. Çalışmamızın birinci bölümüne kayboluş-hükmen ölü sayılma sürecindeki mefkûd üzerinde durduk. İkinci bölümde ise, mefkûdun hükmen vefatının hukuki neticelerine temas ettik. Üçüncü ve son bölümde de vefatına hükmedilen mefkûdun ortaya çıkması halindeki hukuki durumu ele aldık.

Making extensivie references to Hanefi denomination, this study also touches on the opinions of other denominations. Added to these, the regulations and comparisons of the Turkish Civil laws have been referred to in this investigation. The present study consists of four chapters including introduction. The introductory chapter introduces the concepts such as individual and personality. In addititon, it deals with the regulations of the Turkish Civil Law at present. The first chapter presents the judgements with regard to the disappearances. The second chapter deals with the literature review of the disappearences in connection with legal results. Chapter three, the concluding chapter, discusses the disappearenance's legal situation in case he appears.
