İslâm Aile Hukuku açısından Hanefi ve Câferilere göre talâk konusu

Abstract

Evliliği sona erdirme şekillerinden biri de talâktır. Talâk kocanın tek taraflı evliliği sona erdirmesidir. Kocanın, talâk yetkisini nasıl kullanacağını Allah Teâlâ Kur'an'da bizlere bildirmiştir. Allah'ın emrettiği şekilde talâkın gerçekleşmesi için kadının hayızlı olmaması, eğer temizlik döneminde ise o temizlik dönemi içinde onunla ilişkiye girmiş olmaması gerekir. Bunun dışındaki boşama şekilleri Kur'an'a aykırı olacağından geçerli değildir. Talâk, nikâh bağının çözülmesi anlamında Türkçe karşılığında boşamadır. Bu da bain ve ric'î olmak üzere iki kısma ayrılır. İslâm hukukunda boşama yetkisi erkeğe vermekle birlikte kadın da isterse bu yetkiyi Tefviz-i talâk ile kullanılmaktadır. Talâk mubah olmakla birlikte Allah'ın hoşlanmadığı bir ruhsattır. Boşamanın diğer bir türü olan şartlı boşama ve buna bağlı olarak boşama yemini konusunu boşama yemini ile ilgili farklı yaklaşımlar ve günümüz İslâm ülkelerindeki uygulamalar gündeme getirilmektedir. Aynı zamanda çalışmamızda toplumda sıkça rastlanan her türlü hastalıklar ve ya öfke halinde verilen talâkın fıkhı açıdan geçerli olup olmayacağı konusu farklı mezhep hukukçularının görüş ve gerekçeleriyle birlikte incelenecektir.

One of the ways of putting away a marriage is divorce. Divorce is the putting away of the marriage by the husband?s only decision. In the Holy Qur'an Allah has informed us about how the husband can use his right of divorce. According to the commandment of Allah for divorce to take place the woman shouldn't be in her term if she is in her purified period in that period she should have kept herself apart. Apart from this form of marriage any form is contradictory to the Qur'an and is not legal.Talaq (divorce) means of untie the marriage. And that is divided into two parts: these are bain and ric'î the competence of divorce is given to man but the women can use this competence if she wants. Allah (God) regrets the divorce even if it is allowed. Conditional divorce and in relation to this the topic of divorce oath are examined. By taking up the place of the subject within the systematic of İslamic law, different approaches about both the conditional divorce and divorce oath and current practices in the İslamic countries are discussed. This study also includes some soggestions about the subject.In this thesis under the title of the divorce of the man in the case of kinds of diseases or anger? we have tried to examine and discuss the theme of anger is valid or not from the angle of taking into consideration the views of various religious school and whit their proofs.
