Devletin evrensel yargı yetkisi ve Uluslararası Hukuk

Abstract

Bu yüksek lisans tezinin konusu devletin genişlemiş yargı yetkisi olan evrensel yargı yetkisidir. Devlet bünyesinde ülke, insan topluluğu ve egemenlik unsurlarını barındırır ve tüm kullandığı yetkilerini egemenlik kudretinden alır. Bu sebeple devletin egemenliğinden doğan geleneksel yargı yetkisi egemenliğinin sınırları içerisindeki olaylarda söz konusudur. Ancak küreselleşen dünyada devlet sınırları esnetilmiş egemenlik mutlak çerçevelerden çıkarılmıştır. Dünyanın düzenini korumak, tüm insanlığa yönelen suçları cezasız bırakmamak için istisnai olarak devletlerin yargı yetkisi genişletilerek egemenlikleri dışında meydana gelen bazı suçlara ilişkin de yargı yetkisi olduğu kabul edilmiştir. Bu genişleyen yargı yetkisi niteliğine binaen evrensel yargı yetkisi olarak adlandırılmıştır. Evrensel yargı yetkisi birçok uluslararası sözleşmede ve ulusal mevzuatta yer bulmuştur.Bu yüksek lisans tezinin amacı evrensel yargı yetkisinin genel esaslarını belirlemek, örnekler üzerinden incelemektir. Bu doğrultuda birinci bölümde devletin yargı yetkisi incelenerek geleneksel yargı yetkisi ve genişletilmiş yargı yetkisi ayrımına gidilmiştir. İkinci bölümde devletin evrensel yargı yetkisinin çerçevesi belirlenmiş üçüncü bölümde uluslararası sözleşmelerde ve ulusal mevzuatlarda devletin evrensel yargı yetkisinin görünümleri irdelenmeye çalışılmıştır.

Subject of this master's thesis is universal jurisdiction power which is enlarged jurisdiction of the state. Within the structure of the state, country contains community and sovereignty factors and takes all the authorities from its own sovereignty capacity. For this reason, traditional jurisdiction power arising from sovereignty of the state comes into question for the events within the boundaries of its sovereignty. In the globalizing world, however, boundaries of the state have been stretched and removed from absolute frames. In order to protect the world order and to not leave the crimes heading towards whole humanity without punishment, it has been accepted that by enlarging jurisdiction powers of the states, exceptionally, they have jurisdiction power relating to also certain crimes which occur outside of their sovereignties. This enlarged jurisdiction power is called as universal jurisdiction power, considering its qualification. Universal jurisdiction power takes place in many international agreements and national legislation. The purpose of this master's thesis is to determine general principles of universal jurisdiction power and to examine over the instances. In this direction, by examining jurisdiction power of the state, a distinction is made between universal jurisdiction power and enlarged jurisdiction power, in chapter one. In chapter two, frame of universal jurisdiction power of the state is determined, and in chapter three, it is tried to examine views of universal jurisdiction power of the state in the international agreements and national legislations.
