The freedom of expression and its reflections in Turkey in the frame of the decision of ECTHR

Abstract

İfade özgürlüğü temel hak ve özgürlüklerin en önemli parçasıdır ve demokratik toplumların olmazsa olmaz parçasıdır. İfade özgürlüğü her demokratik hukuk devletinde kilit noktadır. Bütün dünyada ve Avrupa'da ifade özgürlüğü büyük öneme sahip olduğu için bu özgürlük, demokratik toplumlarca koruma altına alınmaya çalışılmaktadır ve sağlanan özgürlüklerin boyutu genişledikçe doğru orantılı olarak ülkelerin demokratikliği o kadar artmaktadır. Türkiye'de bu kavram çok eleştirilmektedir ve ifade özgürlüğü konusunda Avrupa İnsan Hakları Mahkemesi'nin Türkiye aleyhine verdiği birçok karar vardır. Korunması gereken özgürlükler arasında yer alan ifade özgürlüğünün Türkiye'de hukuki boyutunun yanı sıra siyasi boyutu da incelenmelidir. Son zamanlarda yapılan değişiklilerle Türkiye'de ifade özgürlüğünün sınırları daha da azaltılmaya çalışılmaktadır. Ancak bu önlemlerin yeterli olup olmadığı tartışmaya açık bir konudur.

The freedom of expression is the most significant piece of basic rights and freedoms, and is necessary for democratic societies. It is the key point of every constitutional state. Furthermore, it is protected by democratic societies as the freedom of expression, because it has a great importance in Europe and in the whole world and when the provided freedoms are widen, the democracy of the states increase. This concept is criticised very much in Turkey and there are many cases of European Court of Human Rights against Turkey by regarding it. The politicial side of freedom of expression, one of the must-be protected freedoms, should be analyzed as much as the legal side of it. With the recent regulations, the freedom of speech in Turkey is being narrowed. Yet, it is debatable if these measures are enough.
