Türk Ceza Kanunu`nda uyuşturucu veya uyarıcı maddelerin ticareti suçu (TCK m.188/3)

Abstract

Sağlıklı ve devamlılığı olan bir toplum yapısı için, her devlet, uyuşturucu veya uyarıcı maddeler ile mücadele etmektedir. Uyuşturucu madde kaçakçılığı 19. yüzyılın ortalarına kadar yasal bir ticaret olarak kabul ediliyorken, bundan sonra bu maddenin ticaretinin yaygınlaşması, bazı ülkelerde tüketiminin artması, uyuşturucu maddenin tehlikelerini geniş boyutlara taşımıştır. Bu nedenle ülkeler giderek büyüyen bu tehlike karşısında önlemler almaya ve bu önlemleri yasalaştırmaya başlamışlardır.Uyuşturucu veya uyarıcı madde imali, ticareti, kullanımı, diğer ülkeler için olduğu kadar Türkiye için de önemli bir tehdit oluşturmaktadır. Bu nedenle ülkemiz kendi birlik ve bütünlüğünü korumak, sağlıklı bir toplum yapısı oluşturmak amacıyla birtakım düzenlemelerle önlemler alarak bu mücadeleyi kendi organlarıyla gerçekleştirmektedir.Ancak elbette ki, uyuşturucu veya uyarıcı madde sorunu, sadece Ceza Hukukunun değil toplumun hemen her biriminin işbirliği içinde hareket etmesini ve ortak bir çözüm bulmasını gerektiren bir problemdir.Çalışmamız, Türk Ceza Kanunu'nun, uyuşturucu veya uyarıcı madde ticareti suçları ile ilgili düzenlemelerini araştırmak, irdelemek, diğer ulusal ve uluslararası mevzuatlarla birlikte değerlendirmek amacı ile hazırlanmıştır. Bu çalışmada, Türk Ceza Hukukuna ilişkin mevzuatlar, birçok kitap, tez, dergi, makale, rapor, web sayfalarından yararlanılmıştır. Çalışmamın birinci bölümünde; uyuşturucu veya uyarıcı madde kavramı, çeşitleri, uyuşturucu veya uyarıcı madde kavramının gelişim boyutu ve uyuşturucu veya uyarıcı madde niteliği tartışmalı olan maddeler ele alınmıştır. Çalışmamın ikinci bölümünde; uyuşturucu veya uyarıcı maddeler ile ilgili uluslararası çalışmalara yer verilmiştir. Çalışmamın üçüncü bölümünde; Türk Ceza Kanunu'nda yer alan uyuşturucu veya uyarıcı madde ticareti suçları TCK madde 188/3 kapsamında, ayrıntılı olarak ele alınmış, bu madde kapsamında yapılan değişiklikler, konuya ilişkin tartışmalar, karşılaştırmalı olarak irdelenmiş ve Türk Ceza Kanunu'nda uyuşturucu veya uyarıcı maddeleri suçlarının gelişim boyutu özet olarak ele alınmıştır. Çalışmanın sonuç kısmında ise; uyuşturucu veya uyarıcı madde ticareti suçları TCK madde 188/3 kapsamında özet olarak değerlendirilecek ve yine ticaretle mücadelede hangi yöntemlere başvurulması gerektiği gibi konulara da yer verilecektir.Anahtar Kelimeler: Türk Ceza Kanunu, Uyuşturucu ve Uyarıcı Madde, Ticareti,Muhakeme.

Every society is struggling with drugs and stimulants for a healthy social system and to ensure their continuity. Drug trafficking was considered a legitimate trade until the middle of the 19th century, but After this time, The spread of trade of this substance, the increase of consumption in some countries have carried the dangers of drug to large size. Therefore, at the face of this growing threat, the countries have started to take precautions and they have started to legalize to this precautions.Drug and stimulant production, trafficking, use, as each country is a major threat to Turkey. Therefore, Our country is taking measures with certain regulations and is performing with its own bodies in order to maintain its own unity and integrity and to create a healthy society.But of course the problem of drug and stimulant is not just a problem of Criminal Law. It is a problem that almost all the terms of the community must act in cooperation to find a common solution to this problem and to combat. Our study have been prepared for the purpose to research, examine and evaluate along with other national and international legislation to the regulations about drug and stimulant trafficking crimes in the Turkish Criminal Code . İn this study, regulations about the Turkish Criminal Law, many books, theses, journal, articles, reports, web pages were used.In the first part of my study; The concept of drug or stimulant, types, the development dimension of drugs and stimulants crimes and controversial drugs or stimulants were dealt. In the second part of my study; international labor about stimulants and drug were dealt. In the third part of my study; Drugs and stimulants in Turkish Criminal Code that located under the Article 188/3 of the Act were discussed in detail and the changes made under this article, the debates on the subject were examined comparatively and the development of drugs and stimulants offenses were be considered as a summary under the Turkish Criminal Code. At the conclusion of the study; drugs and stimulants trafficking offenses will be considered as a summary under the Turkish Criminal Code Article 188/3 and will be given to the issue as to which methods should be consulted in the fight against trafficking.Keywords: Turkish Criminal Code, Drug and Stimulant, Trafficking, Reasoning.
