dc.description.abstract | isçinin her zaman psikolojik saghgina kimi zaman da psikolojik ve fizikselsaghgina, isyerine ve turn topluma zarar veren isyerinde manevi taciz, cahsmahayatinin kendisi kadar eskidir. Nitekim soz konusu olgunun insan iliskilerininkacimlmaz oldugu, sosyal, ekonomik, siyasi, kisisel olmak uzere 9esitli etkenlerinhukum surdugu is ortaminda var olmasi son derece dogaldir. Bununla birlikteisyerinde manevi taciz 90'h yillann ikinci yansinda basinda ve is Hukukumetinlerinde yerini almistir. Arz ettigi karmasik yapi nedeniyle aynmcilik, cinseltaciz ve stres gibi cesitli kavramlarla kanstinlsa da, isyerinde manevi taciz bukavramlardan farkhdir. Mukayeseli hukuk ile uluslararasi belgelerde olguya iliskin5esitli duzenlemeler bulunmakla birlikte; Turk Is Hukuku'nda konuyu dogrudan elealan yasal bir duzenleme mevcut degildir. dc.description.abstract | Mobbing which always damages the psychological health, sometimes thepsychological and physical health of the employee and the order within theworkplace and within the society, is as old as the work life. It is natural that thisnotion exists at the workplace where rule some factors like social, economical,political, personal ones. Nonetheless mobbing takes its place in the press, in theLabour Law?s documents just at the second part of the 90?s. Because of itscomplicated structure, it is difficult to distinguish it form the notions such asdiscrimination, sexual harassment and stress. But mobbing is different from thesenotions. There exist several dispositions in the comparative law and theinternational documents, but Turkish Labour Law doesn?t contain any special legaldispositions about mobbing. That?s why the objective of this study is to introducethe legal dispositions existing in Turkish law which the target of mobbing canaddress.Keywords :Labour Law, Mobbing, Right of Personality, Human Dignity,Discrimination. | en_US |
