İslâm Hukukunda sorumluluk doktrini açısından kanunu bilmeme hali

Abstract

İslâm Hukuku'na göre ise, ferdin İslâm Ülkesi'nde yaşamını devam ettiriyor olması temel hükümleri bildiğine dair bir karinedir. Konu, usul kitaplarında ? Dâr-ı İslâm'da hükme cehalet özür olmaz.? şeklinde ilkeleştirilmiştir. Buna göre, delâleti ve sübûtu kat'î Kur'an ve hadis metinleriyle belirlenmiş olan temel emir ve yasakları bilmemek mazeret değildir. Ancak, delâleti zannî, sadece hukuk bilginlerinin ictihadla bilebileceği konulardaki bilgisizlikler suç sayılmamıştır. Bununla birlikte kalabalık yerleşim merkezlerinin çok uzağında yaşayan veya Müslümanlığı seçerek İslâm Ülkesi'ne yeni girmiş olan şahsın temel hükümlerdeki bilgisizliği de ispatlanması şartıyla müctehid bilginlerce mazeret kabul edilmiştir. İslâm Ülkesi'nin dışındaki ülkelerde Müslüman olma ve orada yaşamını devam ettirme hali ise bilgisizlik karinesi olduğundan bu haldeki fertlerin temel hükümlerdeki bilgisizliği mazeret kabul edilmiştir.

However, according to Islamic Law, living of an individual in an Islamic Country is a conjecture that proves his awareness of main provisions. The case has become a principle as ?Ignorance of provisions is not an excuse? . Accordingly, being unaware of main commands and prohibitions that are defined by favor of Quran and hadith texts. However, suspective guidance texts, only the ignorance of the cases that are known by law scholars legally are not considered as crime. In addition to this, it is confirmed by muctehid Islam scholars that the ignorance of individuals who lives far from city centers or individuals who has just entered to Islamic Country by adopting Islam will be considered as an excuse on condition that they should prove this. The situation of being a muslim outside the Islamic Country or living there is a conjecture of ignorance that all individuals? ignorance of main provisions who are in this situation is considered as excuse.
