10 Numaralı Kısas Defteri`nin transkripsiyonu ve değerlendirilmesi

Abstract

Bir kişinin canına kast ederek yaşamına son vermek ağır cezadır. Bu suçun hukuktaki cezası kısas etmektir. Kısas yapılamadığında fail bedenî ve maddî bir bedel ödemek zorunda kalmıştır. Osmanlı Devleti ceza hukukunda Tanzimat öncesinde ve sonrasında sıkça başvurulan cezalardan olmuştur. Tanzimat'ın ilanından sonra kısas cezaları için ayrı defterler tutulmaya başlanmıştır. Başbakanlık Osmanlı Arşivi'nden 989 Numaralı Divân-ı Hümâyûn Defterleri kataloğuna kayıtlı, kısas cezasını içeren 1840-1909 yıllarında tutulmuş 10 adet Nefy ve Kısas Defterleri bulunmaktadır. Osmanlı Arşivi'nden temin edilen H.1291-1327/M.1874-1909 tarihli 10 Numaralı Kısas Defteri Nizamiye Mahkemelerinin hükümlerini içermektedir. Çeşitli sebeplerle adam öldürme, eşkıyalık, ev kundaklama, etnik kargaşa, 31 Mart Vakası ve Adana-Ermeni Olaylarına dair hükümler mevcuttur. Bu suçlarda adam öldüren, toplum huzurunu bozmak isteyen ve devlete hainlik yapanlar kısas cezasına uğramıştır. Deftere intikal etmiş davalarda kısas cezasının yanında, kürek, kal'a-bendlik ve hapis cezaları da bulunmaktadır. Çalışmanın Osmanlı Devleti ceza hukuku tarihine ve sosyal durumu üzerine çalışmak isteyenlere fayda sağlayacağını temenni ederiz.Anahtar Kelimeler: Osmanlı hukuku, İslâm hukuku, Kısas, Suç, Ceza.

Taking a life of someone deliberately is a major crime. The punishment of that crime is Qisas (Retribution) in the Islamic Law. When the Qisas is not possible, the perpetrator would be punished physically and financially. Both before and after of Tanzimat, the Qisas was one of the frequently referenced punishments in the Ottoman Penal Law. After the proclamation of Tanzimat, separate records for Qisas punishments were kept.There are ten different Nefy (Exile) and Qisasregisters about the Qisas crimes were kept between 1840-1909 at the number 989 catalogue of Divân-ı Hümâyûn in Prime Ministry Ottoman Archives. The number 10 Qisasregister from H.1291-1327/M.1874-1909; which was provided from the Ottoman Archives, includes the rulings of the Nizamiye courts. There are rulings for various reasons; such as murder, home arson, ethnic disturbance, 31 March Incident and the Armenian Incident of Adana. In these crimes; the people who had murdered, had attempted to disturb the peace and had committed treason had been punished with Qisas. Besides Qisas there are punishments which was recorded to the register; such as imprisonments, penal servitudes (kürek) and confining in the fortress (kal'a-bendlik).We hope that our study would be useful for anyone who wants to study the social conditions and the history of penal law of the Ottoman empire.Key Words: Ottoman Law, Islamic Law, Qisas, Crime, Punishment.
