Mesâlihi mürsele ve şer`î siyâsette uygulaması

Abstract

Biz bu tezimizde ilim talebesinin önem vermesi gereken şeriatın en önemlibablarından iki bab olan Şer'î siyâset ve fıkıh üsûlü münasebetini inceledik.Tezimizde, özellikle fitnenin çoğaldığı, devletlerin ayrıştığı, kanların aktığı,cemiyetlerin çoğalıp her birisinin hak üzerinde olduğunu iddia ettiği günümüzdeümmetin en çok ihtiyaç duyduğu maslahat-ı mürsele ve Şer'î siyâsette uygulamasıkonusunu ele aldık. Tezimiz bir giriş ve dört bölümden oluşmaktadır.Giriş bölümünde genel olarak maslahatın, kısımlarını, İslâm şeriatının onanasıl önem verdiğini ve İslâm'ın beşeriyetin dünya ve ahiret mutluluğu için geldiğihususunu şüpheye mahal kalmayacak şekilde ele aldık.Birinci bölümde maslahat-ımürsele ile maslahat-ı ammenin farkını eski ve yeni âlimlerin maslahat-ı mürselekonusundaki ihtilaf ve tartışmalarını, onunla amel etmenin sıhhatini, mezheplerin bukonudaki tartışmalarını ve onunla müstakil bir delil gibi amel etmenin mezheplerinneş'etinden önce sahâbe ve tabiin döneminden itibaren var olduğunu izah ettik.İkinci bölümde ise, Şer'î siyâsetin tarifi İslâm siyâsî fıkhının özelliklerini, delillerini,maslahat fıkhını, Şer'î siyâsette maslahat-ı mürselenin tatbikini inceledik.Üçüncübölümde ise sahâbe, tabiin ve etbâ-ı tabiinin Şer'î siyâsette maslahat-ı mürsele ileamel etmesini örnekleri ile ve Hz. Ebubekir döneminden Ömer b. Abdulaziz'ekadarki dönemde onunla amel etmelerini ve siyâsî konularda ve ümmetin siyâsîyönüyle alakalı fetvalarda uygulayış biçimini ele aldık. Dördüncü bölümde iseçağdaş siyâset ile ilgili özellikle devlet başkanı seçimi, değiştirilmesi şura vemaslahat-ı mürsele ile ilgisini ele aldık.Sonuç bölümünde ise araştırmamız boyunca elde ettiğimiz bazı önemlisonuçları ve Şer'î siyâsetimizin devam etmesi ve dinimizle bağının te'sisi içinmaslahat-ı mürseleyi ve işlerimizle bağlantısının ehemmiyeti üzerinde durduk.Anahtar Kelimeler: Maslaha Mursel, Şer'iSiyaset, İslam Siyasi Fıkıhı, Fıkıh Usulü

In this research that topic concerned with two sections of the Sharia. These two sections are veryimportant and every seeker of knowledge take them in consideration. They are Islamic (Sharia) policy,and principles of jurisprudence.I shed light on one of the highly needed topic for Islamic nation whichis Al Maslaha Al Mursala and its Applications in Sharia's Poloc. Particularly nowadays whereseditions have been multiplied, countries have been dispersed, blood has been sheded, and cultsbecome numerous and every group claims that it has the absolute right but it is as the Arabic poetsays: `and everyone claims linkage or closenss with Leyla…and Leyla doesn't acknowledge that `.Ihave started this paper by chapter which deals with the common or public interest, its parts, and howthe Islamic sharia pays attention to it. Then I clarified that Islam with no doubt came in for thehappiness of humanity, and for the sake of it be it in this world or in the Hereafter.In the secondchapter, I talked about Al Maslaha Al Mursala (unrestricted interest), the difference between it and thepublic interest, and how the scholars in the past were disagreeing in using it as evidence where Ishowed the rightness of those who were using it as evidence in evaluating, comparing , and givingtheir verdict and opinion in a given matter. Also I quoted from the books of the Four Madhhabs usingAl Maslaha Al Mursala as evidence, and its consideration and its use as a prove in matters before theestablishment of Madhhabs when it was used by the predecessors of the nation such as the companionsand the followers.The third chapter deals with the use the companions, the followers, and theirfollowers to Al Maslaha Al Mursala in the Sharia's policy. I mentioned examples of that starting fromthe period of the Khalifa Abu Bakir to the fifth Khalifa Omar Ibn Abdul-Aziz when I mentioned theiruse of Al Maslah Al Mursala and how they applied it in the section of policies and section of Fatawiwhich related to the political issue of the Umma.The fourth chapter deals with some issues related contemporary policy, particular what is related to thepresident, the change, and the Shura. I have showed the relationship of Al Maslaha Al Mursala withthat.In the conclusion, I have mentioned some conclusions which I have deduced throughout this research.The most important one is that the guarantee of the continuation of our policies, and its linking to ourreligion is to pay attention to the interests (Al Maslaha) and to link our matters to it.Key Words: Al Maslaha (the interest) Al Mursala (unrestrited), The principles of jurisprudence, TheSharia's policy, the companions, and the followers.
