Cessâs`ın nikahla ilgili ayetlere yaklaşımı

Abstract

Ahkâm tefsirleri, Kurân-ı Kerîm'de hüküm bildiren ayetleri açıklayan, İslam hukuku açısından önemli bir yere sahip olan eserlerdir. Bu çalışmada, hicri dördüncü yüzyılda yaşamış olan Hanefi fakihi Ebû Bekr el-Cessâs'ın, Ahkâmu'l Kur'ân adlı eserinde nikâhla ilgili ayetlere yaklaşımı ve bazı tercihleri ele alınmaktadır. Bu çalışma üç ana bölümden oluşmaktadır. Birinci bölümde Cessâs'ın yaşadığı dönemdeki siyasi, sosyal, ilmi ve kültürel durum ile birlikte, Cessâs'ın hayatı, ilmi kişiliği, kendisini yetiştiren hocaları, yetiştirdiği talebeleri ve eserleri ile ilgili bilgiler verilmektedir. Çalışmanın ikinci bölümünde ise, İslam Aile Hukukunun temel konularından olan nikâh konusu ana hatlarıyla ele alınmakta, Hanefi mezhebinin görüşleri temelinde yeri geldikçe diğer mezheplerin de görüşleri belirtilerek aktarılmaktadır. Çalışmanın esasını oluşturan üçüncü bölüm ise, Cessâs'ın Ahkâmu'l Kur'ân adlı eserinde ele aldığı nikâhla ilgili bazı meselelerdeki tercih ve yorumlarından oluşmaktadır. Bu bölümde müellifin nikâh akdini konu alan ayetler ile ilgili yorumları, yaptığı yorumlama işinde takip ettiği yöntem, ayetlerden hukukî sonuçlar çıkarma noktasında izlediği usûl ve ele alınan konularla ilgili görüşleri işlenmektedir. Ayrıca müellifin, ele alınan konu ile ilgili görüşleri, diğer bazı müctehid ve imamların görüş ve ictihadları ile karşılaştırılmaktadır.Anahtar Kelimeler: Cessâs, Ahkâmu'l Kur'ân, İslam Aile Hukuku, Nikâh, Evlilik

Ahkâm commentaries are works which occupy an important position in terms of Islamic law and which explain the verses declaring provisions in Qur'an. In this study, the life of Hanafi Scribe Ebû Bekr-el Cessâs, which lived through the 4th century of Hegira, his attitude towards spousal verses in his work named Ahkâmu'l Qur'an and some preferences of him were analyzed. This study consists of three main sections. The first section includes both the information about the political, social, scientific and cultural situation during the term that Cessâs lived through and the life of Cessâs, his scientific personality, masters educating him, his students and works. One of the key issues of Islamic Family Law which is marriage is outlined at the second section of the study. Legal requirements of wedding contract and requirements supplying it to be valid, people in terms of qualification, the role and the effect of parents' in wedding contract, marriage deal breakers and the issue of bride wealth which is a result of a legal wedding are examined in the bases of Hanafism and from the view of other denominations as the occasion arises. The third section, which is the basis of the study, includes some preferences and comments about some spousal issues which Cessâs mentioned in his work Ahkâm'ul Qur'an.Key words: Cessâs, Ahkâm'ul Qur'an, Islamic Family Law, Spousal, Wedding
