Sınai Mülkiyet Kanunu kapsamında marka hakkına tecavüz halinde hukuki ve cezai sorumluluk

Abstract

Bu yüksek lisans tezinin amacı, 6769 sayılı Sınai ve Mülkiyet Kanunu kapsamında, markanın tescili, korunması ve marka hakkının ihlali halinde, marka sahiplerinin hukuki sorumlulukları ile marka hakkını ihlal eden kişilere yönelik cezai sorumlulukların ele alınmasıdır.Tez çalışmasının konusunu oluşturan marka hakkının genel çerçevesinin ele alındığı birinci bölümde ulaşılan sonuçlarda Türkiye'nin marka hakkının korunması hakkında 1883 tarihli Paris Konvansiyonu, WIPO kuruluş sözleşmesi, Dünya Ticaret Örgütü gibi birçok uluslararası sözleşmeye katıldığı görülmüştür. Bunun yanında markanın tanımı unsurları, markanın elde edilmesi, markanın ret sebepleri ve çeşitleri, markanın fonksiyonları, marka türleri ve markanın tescil aşamaları hakkında bilgiler verilmiştir.İkinci bölümde ise 10.01.2017 tarihli 6769 sayılı Sınai Mülkiyet Kanunu ile marka hakkının korunması hakkında yürürlüğe sokulan daha önceki KHK'lardan farklı olarak sınai ve mülkiyet hukukuna daha kapsamlı bir yapı kazandırıldığı görülmekle birlikte, tez konusuna ilişkin olarak 6769 sayılı kanunla marka hakkının korunması, marka hakkının ihlali hali ve marka hakkının ihlalini içeren fiiller ve marka hakkını ihlalinin internet yoluyla yapılması gibi durumlar birlikte ele alınmıştır.Buna göre marka hakkına tecavüzü içeren fiillerin varlığı durumunda 6769 sayılı kanun kapsamında hukuki sorumluluklar, hukuki tedbirler ve cezai hükümlerle öngörülen dava çeşitleri incelenmiş ve yüksek mahkemelerin marka hakkının ihlali kapsamında açılan davalara ilişkin kararları ve içtihatları ele alınmıştır.Anahtar Kelimeler: Marka hakkı, Mülkiyet, Sınai hak

The aim of this master's thesis is to address the legal responsibilities of the trademark owners and the criminal responsibilities of the persons who violate the trademark right in case of registration, protection and violation of the trademark right within the scope of the industrial and Property Law No. 6769.In the first part, where the general framework of the trademark right which constitutes the subject of the thesis work is discussed, it is observed that Turkey participated in many international conventions such as the Paris Convention of 1883 on the protection of the trademark right, WIPO founding convention, World Trade Organization. In addition, the elements of the definition of the trademark, the acquisition of the trademark, the reasons and types of the trademark rejection, the functions of the trademark, the types of the trademark and the stages of registration of the trademark are given.In the second section, the Industrial Property Law No. 6769 dated 10.01.2017 gives a more comprehensive structure to the industrial and property law, as opposed to the previous Khk which was put into effect on the protection of the trademark right, the protection of the trademark right, the violation of the trademark right and acts involving the violation of the trademark right and the.Accordingly, in case of acts involving infringement of the trademark right, legal responsibilities, legal measures and criminal provisions in the scope of Law No. 6769 are examined and the decisions and case law of the high courts related to cases opened within the scope of infringement of the trademark right are taken into consideration.Keywords: Trademark right, property, Industrial right
