Eser sözleşmesinde ayıptan sorumluluk hükümleri ile Borçlar Kanunu genel hükümlerinin yarışması

Abstract

Bu tezde konusu itibariyle, sınırlı bir sorumluluk rejimi öngören eser sözleşmesinde ayıptan sorumluluk hükümleri ile Borçlar Kanunu genel hükümlerinin yarışması konusu ele alınmaktadır. Yüklenicinin ayıptan sorumluluğu, işsahibinin ayıp karşısında kullanabileceği hakları, taleplerin yarışması konuları anlatılmış ve eser sözleşmesinde ayıptan sorumluluk hükümleriyle yarışması muhtemel görülen Borçlar Kanunu genel hükümlerinden hangilerinin yarışıp yarışmadığı ele alınmıştır.

This thesis is based upon the concurrence subject of liability provisions due to the defect in the contract of work which provides a limited liability regime and generel provisions of the code of obligations. Subjects of defect liability of the contractor, rights of the business owner against defect, concurrence of demands are described. And then the possible concurring general provisions of the code of obligations that are in concurrence with the defect liability provisions are handled.
