Sexula margins: A study on an ethnography of `the state` and women sex workers in İstanbul

Abstract

Bu tez, devletin düzenleyici işlevleriyle kadın seks işçileri arasındaki ilişkiyebakarak, devletin cinsel kıyılarının nasıl oluştuğunu açıklamayı hedeflemektedir. Buçalışmadaki en önemli nokta devletin mevcudiyetini bu kıyılarda nasıl erkek olarakkurduğudur. Tüm bunları açıklamak için, kayıtlı ve kayıtsız fuhuşla ilgilidüzenlemeler, disiplin mekanizmaları ve çeşitli pratiklerin karşılaştırması yapılmıştır.Sessizlik, mekan ve şiddet analitik kavramlar olarak ele alınarak, devletin bukıyılardaki belirli bir performans biçimi araştırılmaktadır. Bu bağlamda, hem kayıtlıhem de kayıtsız çalışan kadınlar sürekli olarak istisnai öznelere dönüştürülürken,aynı zamanda bu kadınların devletin ve toplumun kıyılarına sürgün edilme biçimleri,iki farklı devlet kıyısının oluşmasına tekabül eder.Kıyıların kurulmasındaki en önemli farklar, birinin sabitliğine karşılıkdiğerinin hareketli olmasında yatar. Bu karşılaştırmanın ortaya koyduğu en önemlinokta, yasanın sadece kayıtlı kadın seks işçisini özne olarak kurmasındaki araçsallığıdeğil, aynı zamanda kayıtsız kadını da bu düzenlemelere başvurarak nasıloluşturduğudur. Fakat düzenlemeler, kayıtsız çalışanlarda gayet kişisel iradeleredayanmakta ve böylece sürekli değişiklik göstererek istisna halini her an ortayaçıkarabilecek bir hükümranlık biçimine izin veren keyfiyet alanı yaratmaktadır.

This thesis aims to analyze the construction of sexual margins of ?the state?as a specific relation between the ordering functions of ?the state? and women sexworkers. The main point in this study is how ?the state? establishes itself as amasculine body in these margins. To achieve this goal, it compares the regulations,disciplinary mechanisms and various practices related to legal prostitution on the onehand and illegal prostitution on the other.By conceptualizing silence, space, and violence as analytical tools, aparticular performance of ?the state? is explored through margins in both sovereignand governmental terms simultaneously. In this context, while licensed andunlicensed women are continuously rendered exceptional subjects, the ways in whichthey are exiled to the margins of the state and of the public designate two differentconstructions of ?the state?s? margins.The main differences in the construction of these margins lies in the stabilityof the former compared to the fluidity of the latter. The main point that thiscomparison reveals is the extent to which the letter of the law is instrumental inconstituting not only the legal sexual woman worker as subject, but also how,through reference to these regulations, the illegal woman sex worker. However, inhis latter case, regulations become extremely subject to individual wills, andtherefore unstable, thereby constructing a space of arbitrariness that allows a form ofsovereignty based on the constantly imminent exception.
