Türk hukuk sisteminde profesyonel futbolcu sözleşmelerinin incelenmesi

Abstract

Profesyonel futbolcu sözleşmesi, profesyonel olarak futbol oynamak isteyen sporcular ile bünyesinde profesyonel olarak futbol branşı barındıran kulüpler arasında imzalanan sözleşmelerdir. İş sözleşmesi niteliğinde olan profesyonel futbolcu sözleşmeleri Türkiye Futbol Federasyonun belirlediği talimatlar dahilinde düzenlenir. Sözleşmenin tarafları arasında karşılıklı borç ve hak ilişkisi doğurur ve tarafların bunlara riayet etmesi esastır. Sözleşmenin süresi içinde veya bitiminde ortaya çıkacak anlaşmazlıklar TFF dahilinde oluşturulan uyuşmazlık çözüm kurulu tarafından incelenir ve bu kurulun verdiği kararlara karşı taraflar tahkim kuruluna başvurma hakları mevcuttur. Bu çalışmanın amacı, futbolun büyük ilgi gördüğü Türkiye'de kulüpler ve profesyonel futbolcular arasındaki hukuki ilişkiyi incelemektir. Bu amaç doğrultusunda da bir futbolcunun kulübe transferi veya mevcut futbolcunun aynı kulüpte oynamasına devam etmesini hukuki olarak resmileştiren profesyonel futbolcu sözleşmeleri 'futbolcu iş sözleşmesi ve kavramlarını, sözleşmeden doğan hak ve borçları, profesyonel futbolcu sözleşmesini, sözleşmenin sona ermesi ve sonuçlarını ve uyuşmazlıkların çözümü' adlı başlıklar altında incelenmektedir.

Professional footballer agreement is a contract signed between the athletes who want to play football professionally and the clubs that have football branches within themselves.Professional footballer contracts which have the characteristics of the employment contract are arranged by the instructions that Turkey Football Federation specifies.It creates a mutual debt and rights relationship between the parties of the agreement and it is essential that the parties comply with them.Disputes that may arise during or at the end of contracts are considered by the dispute adjudication board established by TFF and the parties have right to apply to the arbitration board against the decision of this board.The aim of this study is to investigate the legal relationship between the football clubs and professional footballers in Turkey where football has a great interest.In line with this purpose it is investigated under titles such as; transfer of a footballer to a club or professional footballer contracts which legally formalized the current footballer's continue playing in the same club,footballer employment contract and it is concepts,rights and debts arising from contract,professional footballer contract,end of the contract and its outcomes , settlement of disputes.
