Osmanlı esnafının sosyo ekonomik ve kültürel hukuku

Abstract

Bu çalışmanın amacı Osmanlı Devleti'nde faaliyet gösteren esnafların sosyo ekonomik ve kültürel hukuklarını tespit etmektir. Bu amaçla çalışma dört ana bölüm üzerine kurgulanmıştır. Birinci bölümde Osmanlıda esnaflığın tarihsel temeli, sosyal ve kültürel bağlamlar göz önüne alınarak incelenmiştir. İkinci bölüm, esnaflık ve esnaflığın toplumsal ve kültürel özelliklerine ayrılmıştır. Üçüncü bölümde esnafın piyasa içinde görevini icra ederken tabi olduğu ekonomik koşullar tahlil edilmiştir. Son bölümde esnafın anılan hukuka uygun davranıp davranmadığının kontrol edildiği denetim mekanizması, esnaf tarafından işlenen suçlar ve bunların gerektirdiği cezalara ayrılmıştır. Sonuç olarak Osmanlı Devleti'nde esnaflığı belirleyen sosyal ve kültürel hukukun temellerinin tarihsel olarak fütüvvet ve ahiliğe dayandığı anlaşılmıştır. Ekonomik hukuk ise esnafın, halkın temel ihtiyaçlarının iyi bir şekilde karşılayacağı tüketici odaklı bir anlayışla biçimlenmiştir. Denetim mekanizması bu sistemi koruyacak şekilde inşa edilmiştir. Toplumu olumsuz bir şekilde etkileyen esnaf ihlalleri, gerektiğinde ağır cezalarla engellenmeye çalışılmıştır. Bu anlayış Osmanlı ekonomik ve toplumsal yapısının uzun süre devamlılığını sağlamıştır.

This study aims to objectify the socio-economic and cultural laws of the craftsmen in the Ottoman Empire. For this purpose, the study was designed on four main chapters. In the first chapter, the historical background of craftsmanship in the Ottoman Empire was examined by taking into consideration the social and cultural contexts. The second section is devoted to the social and cultural characteristics of craftsman and craftsmanship. In the third chapter, the economic conditions that the craftsmen were subject to were analysed while performing their duties within the market. In the last section, the control mechanism in which the craftsman behave according to the law is divided into crimes committed by the craftsmen and the penalties required by them. As a result, it has been concluded that the foundations of social and cultural law which determine the craftsmanship in the Ottoman Empire are historically based on Islamic code and ahi-order. However, the economic law has been shaped by a consumer-oriented approach that the craftsmen will meet the basic needs of the people in a positive way. The control mechanism has been built to protect this system. Artificial violations of the craftsmen affecting the society in a negative way have been tried to be prevented with heavy penalties when necessary. This understanding has ensured the continuity of the Ottoman economic and social structure for a long time.
