34 numaralı Kalebend defterine göre (S. 1-106) h. 1230-1231 / m. 1815-1816 yılları arasında Osmanlı Devleti`nde suç, suçlu ve cezalar (Değerlendirme-metin)

Abstract

Kalebendlik terim olarak bir kimsenin herhangi bir suçtan dolayı devlet tarafından tayin edilecek bir kalede ceza müddetinini tamamlayıncaya veya affedilinceye değin belirli bir süre zarfında kale hisarından dışarı çıkmasına izin verilmemesi cezasıdır. Kalebend Defterleri ise kalebend cezasının da içinde bulunduğu çeşitli ceza hükümlerinin yer aldığı Divan-ı hümayun kararlarını içeren resmi kayıtlardan oluşmaktadır. Aynı zamanda bu defterler içerisinde çeşitli sebeplerle affedilip, ıtlak edilen hükümlülerin kayıtları da mahfuzdur.İncelemeye tabi tuttuğumuz bu çalışmada ise; belirli tarihsel sıralama ile yazılmış olan bu defterlerden, H. Şevval 1230 ile Zilhicce 1231 (M. Eylül-Ekim 1815 – Ekim-Kasım 1816) tarihleri arasını kapsayan 34 Numaralı Kalebend Defteri'nin transkripsiyon ve değerlendirilmesi gerçekleştirilmiştir.Anahtar Kelimeler: Kalebend, Suç, Ceza, Itlak

Kalebend (castle-bend) Penalty, as a term used in science of history, is a kind of punishment that people charged with an offense are kept as a prisoner in a Castle chosed by the State and is not allowed to go to out of the fortress of the castle until they finish their imrisonment period or they are forgiven.As to Kalebend books; these are books which consist of official records related to the imperial council (Divan-ı hümayun) verdicts about the kind of punishment mentioned above, during the terms of Ottoman Empire. The books also contain official records of verdicts who were forgiven due to various reasons and thus got released.İn the present study, among many Kalebend books written in chrolonogical order, the 34 numbered Kalebend book concerning verdicts written between dates of Shawwal-1230 and Dhu'l-Hijja-1231 (İslamic Calendar) is examined, transcription, assessment and surveying of the book are made.Keywords: Kalebend, Crime, Penalty, Release
