dc.description.abstractMarkanın üçüncü kişi tarafından malların ve hizmetlerin kaynağıkonusunda karıştırılmaya sebep olacak kullanımı marka hakkına tecavüz teşkiletmektedir. Karıştırılma ihtimalinin varlığının belirlenmesinde göz önündebulundurulacak pek çok unsur bulunmaktadır. Bu çalışmanın esas amacı da buunsurlara açıklık getirerek karıştırılma ihtimali kavramının anlamınıbelirleyebilmektir.
dc.description.abstractTrademark infringment occurs when one party uses a trade mark of anothersuch that there is confusion in the minds of consumers as to the the source of productor service. The appreciation of the likelihood of confusion depends on numerouselements which includes the strength or weakness of the trademark, the similarity inthe appereance, sound and the meaning of the signs, the similarity of the goods orservices in the question, proximity of the marketing or the distrubition chanells of thegoods, and actual evidence of confusion on the part of the public which includes thelikelihood of association between the sign and the mark. The main aim of this studyis to define when there is a likelihood of confusion in the mind of consumers.en_US
