Tanzimat Dönemi itibarıyla Osmanlı tabiiyyetinin (vatandaşlığının) gelişimi

Abstract

oz Çalışmada, `Osmanlı Devleti'nin Tanzimat Dönemi'ndeki tâbiiyyet (vatandaşlık) anlayışının gelişimi` araştırılmıştır. Çalışmanın temelini, belirtilen dönemde devletin, tebaa (vatandaş) statüsünü nasıl tespit ettiğine ve söz konusu statüye hangi hukukî sonuçları bağladığına ilişkin sorunlar oluşturmuştur. Konu, hukukî metinler (fermanlar, anayasalar, ilgili kanunlar ve diğer hukukî düzenlemeler) ışığında, tarihsel sıra takip edilerek incelenmeye gayret edilmiş, ayrıca hukukî metinleri etkileme yeteneğinde olan siyasî olaylar ve devlet teorilerine de değinilmiştir. Tezin esası, bir devlete, belirli bir dönemdeki tâbiiyyet olgusuna dayandığından, tâbiiyyet (vatandaşlık) kavramının tanımı ve kavramın tarihî gelişimiyle incelenmeye başlanmış, daha sonra Osmanlı Devleti'nin Tanzimat Dönemi itibarıyla söz konusu kurumun araştırılmasına geçilmiş, hukukî metinler bağlamında devletin bu statüyü ne şekilde tanımladığı, hangi imkan (`hak`) ve mükellefiyetleri vatandaşlık statüsüne bağladığı sorularının cevapları aranmıştır. Neticede Osmanlı Devleti'nin vatandaşlığı, kendi topraklarında yaşayan, siyasî iktidarına tâbi insan unsuruna, herhangi bir din ayrımı yapmaksızın verdiği, bu statüye bağlanan sonuçların ise Tanzimat Dönemi'nden itibaren, özellikle gayri müslimler bakımından değişiklikler geçirdiği görülmüştür. Zira bu dönemde vatandaşlığın hükümleri `eşitlik` esasına dayandırılmaktaydı. Ek olarak `tebaa haklan`nın da bir kenara bırakılmadığı, Tanzimat Fermanından itibaren, tebaa bakımından müslim, gayri müslim farklılığına gidilmeksizin, dönemin ferman ve anayasalarında, söz konusu haklardan ve bunlarla beraber yükümlülüklerden de bahsedildiği belirtilmelidir. Tüm bu gelişmelerden hareketle, Osmanlı Devleti'nin, Tanzimat Dönemi itibarıyla `tebaa`sını belirlerken, bir modern devletin `vatandaşını tanımlama ölçütlerinden, pek de farklı kriterler kullanmadığı sonucuna varılmıştır. Ancak 1839'dan 1918'e kadar süren Tanzimat Dönemi'nin (özellikle haklar ve hakların anayasal garantileri bakımından) 1839'daki tebaası ile II. Meşrutiyetin ilanı sonrası tebaasının farklı durumda olduğu da ifade edilmelidir. Ayrıca Osmanlı Devleti'nin Tanzimat Fermanı'ndan (bu süreç III. Selim zamanına kadar geri götürülebilir) itibaren, (batı tipi) modernleşme hedefine yönelmiş bulunduğu da belirtilmelidir ki bu eğilim devletin vatandaşlık anlayışındaki gelişmeleri de etkilemiştir. 111

ABSTRACT This thesis inquires into notion of citizenship during Tanzimat (Reform) period (1839 - 1918) in the Ottoman Empire. It concerns specifically with the questions regarding the legal conditions and consequences of the citizenship status in the given period. The writer, in this context, looks at legal documents such as; constitutions, statutes, decrees, and other legal acts, following their historical occurrences. Furthermore the writer examines these legal documents in the light of political atmosphere and theories which had a background influence in this period. This thesis starts with the definition of citizenship, scrutinizes its historical development, and continues with evaluating the meaning of this notion during the Tanzimat Period. In connection with this last inquiry, which is the main focus of this work, particular attention has been given to the Ottoman State's perception of citizenship. This perception is searched by looking at legal acts declaring legal rights and duties of citizens of the Ottoman Empire. In conclusion, the writer observes that the Empire granted the citizenship rights regardless of their religious beliefs to all residents who lived under the Empires sovereign power within the Ottoman land. As for the legal consequences of the citizenship status, it began to change especially for non-Muslims with the Tanzimat Period. In this period, the notion of citizenship had been understood together with the principle of equality. Consequently, all rights and duties legally associated with citizenship bore no difference for Muslim and non -Muslim population groups of the Empire unlike the classical period of the Empire. Taking account of all these developments, the writes reaches the conclusion that the Ottoman Empire used criteria to grant citizenship within this period, which were no different from criteria implemented by `modern states`. Regarding to the legal rights of citizens and their constitutional guarantees, legal institution of citizenship improved within the Tanzimat Period at several stages starting the Tanzimat Decree and ending with the Second Constitution of the Monarchy. Finally, the writer observes that the underlying motive of these improvements and changes regarding the Ottoman citizenship was the Empire's strong desire for the western type modernisation. IV
