Emeklilik sözleşmesi

Abstract

07.04.2001 tarih ve 24366 sayılı Resmi Gazete'de yayınlanan 28.03.2001 tarih ve 4632 sayılı Bireysel Emeklilik Tasarruf ve Yatırım Sistemi Kanunu'yla, kamu sosyal güvenlik sisteminin tamamlayıcısı olarak, bireylerin emekliliğe yönelik tasarruflarının yatırıma yönlendirilmesi ile emeklilik döneminde ek bir gelir sağlanarak refah düzeylerinin yükseltilmesi, ekonomiye uzun vadede kaynak yaratarak istihdamın arttırılması ve ekonomik kalkınmaya katkıda bulunulmasını sağlamak amacıyla, isteğe bağlı katılıma dayanan yeni bir emeklilik sistemi oluşturulmuştur.Bu doktora tezi, Türk Sosyal Güvenlik Sistemi'nde oluşturulan bu yeni emeklilik sistemine katılım için akdedilmesi gereken emeklilik sözleşmesini bütün yönleriyle ele alıp incelemeyi amaçlamaktadır.

By virtue of the Law on Individual Pension Savings and Investment System dated 28.03.2001 and No. 4632 which was published in the Official Gazette dated 07.04.2001 and No. 24366, in order to: (i) direct individuals' pension savings towards investment; (ii) provide individuals with additional income in their retirement periods which would increase their life standards; (iii) provide resources to economy in the long run and therefore increase employment; and (iv) contribute to the economical development, a new retirement system on a voluntary basis (which complements the state social security system) has been established.This doctorate thesis aims to consider retirement contracts, which are required to participate in the retirement system that has been recently established in the Turkish Social Security System, from all aspects.
