Türk, İngiliz ve Meksika Hukukunda cinsel suç mağdurunun korunması

Abstract

Günümüz çağdaş hukuk anlayışında bireysel hak ve özgürlüklerin ön planda tutulmasıdevletlerin suç politikasına etki etmekte, bu etki ise kendini özellikle suç tiplerineilişkin kanuni düzenlemeler ile mağdura sunulan koruma alanının çerçevesindegöstermektedir. Bu çalışmada Türk, İngiliz ve Meksika ülke mevzuatlarında cinsel suçtiplerine ilişkin kanuni düzenlemeler ile mağdurun ceza muhakemesi sürecindekikonumu değerlendirilerek üç ülke ceza adalet sisteminde teori ve pratik açıdanmağdurun korunmasına yönelik yaklaşımlar izah edilmektedir.Anahtar Kelimeler: Cinsel suçlar, cinsel suç mağduru, Meksika hukukunda cinselsuçlar, İngiliz hukukunda cinsel suçlar, cinsel suç mağdurunun korunması, ikincilmağduriyet.

Today's modern understanding of law accepts the individual rights and freedoms on thefront line that causes an effect on states in their crime policy and such an effect showsitself in the frame of protection offered to the victim through legal arrangements.
