Uyuşturucu veya uyarıcı madde kullanma suçu (TCK m. 191)

Abstract

Dünyanın en önemli sorunlarından biri haline gelen uyuşturucu veya uyarıcı madde kullanımı, insan sağlığını tehdit etmektedir. Uluslararası alanda yürütülen mücadele ile birlikte, ülkemiz de kendi iç hukukunda bir takım düzenlemeler yaparak bu mücadeleye destek olmaktadır. Bu çerçevede, 5237 sayılı Türk Ceza Kanunu'nun 191. maddesinde uyuşturucu veya uyarıcı madde kullanma suçu hüküm altına alınmıştır. Bu çalışmada, kullanmak için uyuşturucu veya uyarıcı madde satın almak, kabul etmek veya bulundurmak ya da uyuşturucu veya uyarıcı madde kullanmak fiilleri hakkında bilgiler verilmiş ve konuya ilişkin Yargıtay içtihatları incelenmiştir.

Drug or stimulant use, which has become a serious threat for human health, is one of the biggest issues at present in the world. Beside the international fight against drug or stimulant use, a set of legal regulations in Turkey are made in the same vein for his very purpose. In this regard, under the article of 191 of Turkish Criminal Law no. 5237, to use drug and stimulant is identified as an offence. In this study, information about offences of to buy, to take or to possess drug or stimulant for purpose of use is provided at length and Supreme Court jurisprudences with regard to the above-metioned offences are examined.
