İnsan Hakları Avrupa Mahkemesi içtihadında ve Türk Hukukunda toplanma özgürlüğü

Abstract

Bu tez çalışmasında, İnsan Hakları Avrupa Mahkemesi (İHAM) içtihadında ve Türk hukukunda toplanma özgürlüğü konusu ele alınmıştır. Bu bağlamda, çalışma ile amaçlanan; toplanma özgürlüğünün felsefi, tarihi ve kavramsal boyutlarını ortaya koymak; yine bu çerçevede, İnsan Hakları Avrupa Sözleşmesi (İHAS) kapsamında özgürlüğün teorideki ve uygulamadaki sınırlarını saptamaktır. Toplanma özgürlüğü İHAS'ın 11. maddesinde koruma altına alınmıştır. Temel haklardan addedilen barışçıl toplanma özgürlüğü hakkı, 11. madde hükmüyle herkese tanınmıştır. Daha açık bir anlatımla; bireyler, gruplar ve örgütler bu hakkı kullanabilmektedir. Dahası, toplanma özgürlüğü, demokratik toplumun vazgeçilmez esaslarından biridir; ancak bu, özgürlüğün sınırsız olduğu anlamına gelmemektedir. Bununla birlikte, Türk hukukunda toplanma özgürlüğü hakkı, 1982 Anayasası'nın 34. maddesinde ve 2911 sayılı Toplantı ve Gösteri Yürüyüşleri Kanunu'nda hüküm altına alınmıştır. Ancak 2911 sayılı Kanun 1982 Anayasası'na, İHAS'a ve İHAM içtihadına her bakımdan aykırıdır. Bu nedenle Kanunun İHAM içtihadı ışığında değiştirilmesi gerekmektedir. In this thesis, freedom of assembly under the case law of the European Court of Human Rights (ECtHR) and Turkish Law have been studied. In this regard, with this study we have aimed to identify philosophical, historical and conceptual dimensions of freedom of assembly and in this framework to determine borders of freedom of assembly according to the European Convention on Human Rights (ECHR) in human rights theory and its application. Freedom of peaceful assembly has been guaranteed under the Article 11 of the ECHR. This freedom has been defined as a fundamental right under the Article 11 and this Article provides that everyone has the right to freedom of peaceful assembly. More clearly, the right can be exercised by individuals, groups and associations. Furthermore, freedom of assembly is regarded as one of the indispensable principle of a democratic society; but this freedom is not without limits. On the other hand, in Turkish law, right to freedom of assembly has been ensured under the Article 34 of the Constitution of 1982 and Act no. 2911 on Meetings and Demonstration Marches. However, the Act no 2911 incompatible with the Constitution of 1982, the ECHR and case law of the ECtHR on account of all. Therefore this Act must be amended in the light of case law of the ECtHR.
