Kıymetli evrakta ciro kavramı

Abstract

Bu yüksek lisans tezinde ciro bir kavram olarak ele alınmakta, bu kapsamda yapılış amacına göre ciro türleri ve buna ilişkin hükümlerin kambiyo senetlerinin yanında diğer emre yazılı kıymetli evrakta ne şekilde uygulanacağı farklılıklara değinilerek incelenmektedir. TTK'da yer alan ciroya ilişkin maddeler içerik olarak İsviçre Borçlar Kanunu, Alman Poliçe ve Çek Kanunu ile ortaktır. Bu nedenle yerel doktrinde ileri sürülen görüşlerin ve yargı kararlarının yanında İsviçre ve Alman doktrinindeki tartışma ve içtihatlara da yer verilmiştir. Tez konumuz birçok alanla ilişkili olduğundan bütünlüğün sağlanması adına yan alanlara konuyu ilgilendirdiği ölçü ile sınırlı olarak irtibat kurulmuştur. Çalışmamızda, cironun tanımı, tarihçesi, hukuki niteliği, şekli, incelendikten sonra yapılış amacına göre ciro türleri ele alınmıştır.

In this master thesis, endorsement is considered as a concept and in this context, the types of endorsement according to the purpose of construction and the related provisions are examined with reference to the differences in the manner, in which they are applied to the other order instruments. The articles related to the endorsement in the Turkish Commercial Code are similar with the Swiss Code of Obligations and the German Bill of Exchange and Check Law. Therefore, in addition to the opinions and judicial decisions put forward in the local doctrine, discussion and case law in the Swiss and German doctrine are also included. Since our thesis is related to many fields, it has been limited to the extent that it concerns the side areas in order to ensure integrity. In our study, after the definition of the endorsement, its history, its legal nature and its form are examined, the types of endorsement according to the purpose of its construction are also studied.
