Abstract
Bu qaligma, bir giriq ile iki bolumden olugmalttadir. Girig bolumundekonunun onen~i, sin~rlandlr~lmas~am, act ve ltaynaltlarindan bahsedilrnigtir.Cal~gman~bnir inci bolumu dbrt kisma ayrrlmiqtir. Birinci ltisimda tore, orf, iidetkavrarnlari; iltiiici ltisimda hultultsal ve sosyolojilt olaralt tore; uquncii ltisimdatorenin unsurlari; dordiincii ltisim da ise torede ltadinla ilgili ogeler ve bunlarsn Islamhultukuyla iligkisi iizerinde durulmugtur.Calrgmanln ikinci bolumu ise uq kisma ayrilmigt~r. Bu bolumun birinciltisminda tore cinayetleri, sosyolojilt aqidan degerlendirilmigtir. Ikinci kisiinda suqunqegitleri, ta'zir cezasi ve zinii uzerinde durularak bu hususlarin Islam hultfiltundaltiyeri ve tijre ciniiyetlerine sebebiyet veren suglarla iligltisi tespit edilmigtir. ~qiinciikisimda ise tore cinayetlerinde cezayl duquren sebepler uzerinde ayrintsll bir geltildedurulmugtur.Klasik fsltih kitaplariiida tore ciiiiiyetleri ad1 alttnda herhangi bir ba~likmevcut degildir. Ancalt ltonuyla ilgili bir taltim bilgiler buluimalttadir. Giinumuzdetanilt olunan tore ciniiyetlerinin 1slam huktikunda herhangi bir dayanagi yolttur. Buciniiyetler, tore cinayetleri adlandlrilmaslndan da anlagilacagi gibi temelini yoresel vetoresel olgulardan almaktadir. This study consists of an introduction and two chapters. In the introductionthe significance of the subject, its definition, purpose and resources are discussed.The first chapter of the study is divided into four sections. In the first sectionconcepts of custom, comlnon usage, practices; in the second section legal andsociological aspects of custom; in the third section elements of custom; in the fourthsection element5 related to woinen and their relationship with the Islamic law are thefocus points.The second chapter of the study is divided into three section. In the firstsection of this chapter sociological aspects of custom and honour killings areevaluated. In the second section the crime types, penalties for sexual harrastnent(ta'zir) and adultery (zina) are studied, and the place of these concepts in the Islamicand their relationship with the crimes that lead to custom and honour killings aredetermined. Whereas in the third section the reasons for penalty deduction in customand honour killings are given in detail.There is no chapters found in the classic law books under the title custom andhonour killings. However, some information can be found on this topic. There is nobasis in the Islamic law for custom and honour killings which take place in our age.These murders, as it referred froin its name derives from local and traditional facts.
