Abstract
Bu çalısmada, esas olarak hem Medeni Yargılama Hukuku hem de dariYargılama Hukuku'nda davadan feragat hukuki müessesesi incelenmis iki yargılamausulü arasındaki farklar ortaya konulmustur. Diger taraftan uygulama örnekleriylebu farkların sebepleri ortaya konulmaya çalısılmıstır.Üç bölümden olusan tezin birinci bölümde; davadan feragat kavramı vehukuki niteligi, özellikleri, benzer kavramlarla karsılastırılması ve feragat niteligitasımayan durumlar incelenmistir.kinci bölümde; feragat edilemeyecek davalar ve davadan feragat edebilecekkisiler ele alınmıstır.Üçüncü bölümde; davadan feragatin konusu, sekli, zamanı, mahkemeninverecegi karar, karara karsı kanun yollarına basvuru, feragatin iptali ve hüküm vesonuçları üzerinde durulmustur.Çalısmada, netice olarak, davadan feragat hukuki müessesinin idari yargılamausulündeki uygulamasının medeni yargılama usulünden farklı oldugu sonucunavarılarak bu konudaki eksiklikler ortaya konulmus ve dari Yargılama UsulüKanunu için alternatif kanun maddesi teklifleri önerilmistir. In this study, the legal concern of renunciation of a case is investigatedfundamentally both in Civil Judging Law and Administrative Judging Law; and thedifferences between the two proceedings are displayed. On the other hand, withpractice examples it has been tried to indicate the reasons of those differences.In the first chapter of the three in the thesis; the concept of renunciation of acase and its quality, features, comparison with similar concepts; and situations thatdo not include renunciation are analyzed.In the second chapter; the cases which cannot be disclaimed and people whocan renounce of a case are undertaken.In the third chapter, the subject of renunciation of a case, its method and time,the decision of the court, applying against the decision, the cancellation ofrenunciation, judgement and the results of the judgement are discussed.Consequently, in the study by arriving to a conclusion that the legal concernof renunciation of a case in administrative proceeding practice is different from civilproceeding and the deficiencies are displayed; and for the Law of AdministrativeProceedings alternative notice of motion is suggested.
