Avrupa Birliği`ne tam üyelik sürecinde ticarette teknik engeller: Türkiye`nin uyum sürecinin değerlendirilmesi

Abstract

ÖZET Avrupa Birliği' ne entegrasyonun temel unsurlanndan biri de ticareti engelleyen tarife dışı teknik engellerin aşılması ve AB standardizasyon politikalarına uyum yönünde çalışmalardır. Tarife dışı engeller içerisinde en kapsamlı kategoriyi oluşturan teknik engeller; sağlık, güvenlik, tüketicinin ve çevrenin korunması gibi nedenlerden dolayı malların, kişilerin, hizmetlerin ve sermayenin serbest dolaşımını sınırlayan engellerdir. Avrupa Birliği komisyonu, malların serbest dolaşımını kısıtlayan bu engellerin kaldırılmasına yönelik Eski Yaklaşım Politikası, Yeni Yaklaşım Politikası, Global Yaklaşım ve Modüler Yaklaşım olmak üzere çeşitli politikalar kabul etmiştir. Bu politikaların ortak amacı; sadece teknik mevzuatın uyumlaştırılmasını sağlamak olmayıp, aynı zamanda Avrupa standartlarının geliştirilmesini ve yaygın kullanılmasını da temin etmektir. Avrupa ile tarihsel olarak çok güçlü ticari bağlara sahip olan Türkiye, hem ihracat hem de ithalatında kalite, çevre, güvenlik gibi konularda şimdiye kadar bir çok teknik engelle karşılaşmıştır. Avrupa Birliği'ne tam üyelik sürecinde olan Türkiye 1 Ocak 1996 yılında Gümrük Birliği Anlaşması imzalayarak AB ile ticareti önündeki teknik engellerin kaldırılması yönünde Önemli bir adım atmıştır. Bu çerçevede, kalite, çevre ve güvenlik gibi konularda Türkiye'deki mevcut sistemin AB sistemine uyumlaştırılması yönünde çalışmalar son dönemde hız kazanmıştır. Fakat hala AB standardizasyon, test ve belgelendirme hizmetleri ile Türkiye'deki uygulamalar arasında büyük farklılıklar bulunmaktadır. Bu çalışmada Türkiye'nin AB ile ticari ilişkilerinde ortaya çıkan teknik engeller ayrıntılı bir şekilde ele alınmış, AB'nin teknik engeller konusunda benimsediği politikalar incelenmiş ve son olarak da Türkiye'deki mevcut sistemin AB sistemine uyumlaştırılması yönünde yapılan çalışmaların genel bir değerlendirmesi yapılmıştır. SUMMARY TECHNICAL BARRIERS IN TRADE DURING THE PROCESS OF FULL MEMBERSHIP WITH THE EUROPEAN UNION: AN EVALUATION OF TURKEY'S ADAPTATION PROCESS Keywords: Non-Tariff Technical Barriers The elimination of trade barriers and the adaptation to the standardization policies of the European Union stand as the two major challenges in front of the countries that are in the process of integration with the European Union. Technical barriers constitute the broadest category amongst the non-tariff trade barriers since they prevent the free movement of goods, people, services and capital due to the regulations concerning health, safety, environment and the protection of consumers. The European Union has adopted a number of policies, such as the Old Approach, the New Approach and the Global Approach, to eliminate these barriers that constitute a stumbling block in front of the free movement of goods and services. These policies have not only aimed to harmonize the technical regulations among the EU member countries but also to improve and provide the widespread application of the European standards beyond the borders of the EU. Turkey has historically had strong commercial ties with Europe and has faced with numerous non-tariff technical barriers with regards to quality, environment and safety in its import and export trade. With the signature of the Customs Union with the EU on January 1, 1996, Turkey has taken an important step towards the elimination of the technical barriers in its commercial relations with the EU. Correspondingly, the efforts towards the adoption of the EU system of regulations concerning quality, environment and safety have recently intensified in Turkey. However, there is still a major gap between the standardization, testing and accreditation services in the EU and those in Turkey. Against this background, this thesis firstly examines the non-tariff technical barriers in the context of the commercial relations between Turkey and the EU, secondly provides an overview of the polices of the EU on non-tariff technical barriers and finally makes a general assessment of the recent attempts in Turkey on the adaptation of the existing system to the EU system. «SSKSSS IX
