Abstract
Ekonomik hayatın gelişmesi, hukuki ilişkilerin çeşitlenmesi ve artması nedeniyle işyeri devri kurumunun uygulama alanı ve neticesinde yaşanılan sorunlar artmıştır. Girişim özgürlüğü hakkı çerçevesinde işveren, işyerinin tamamını ya da bir bölümünü bir başkasına devredebilir. İşyerinin devri; bir işletmenin veya işyerinin veya bunların bir bölümünün ekonomik ve teknik amaçlarını gerçekleştirmek üzere, organize edilmiş unsurları ile birlikte kimliği korunarak bir başka işverene devri olarak tanımlanabilir. İşyeri devri, işverenin işyerini hukuki bir işlemle devretmesi, işverenin ölümü, ticaret şirketlerinin birleşmesi ya da tür değiştirmesi şeklinde gerçekleşebilir. İşyerinin el değiştirmesi, işçilerin iş güvencesini tehlikeye düşürebilecek önemli nedenlerden biridir. Hukukumuzda işyerinin devrine ilişkin temel düzenleme, Avrupa Birliğinin İşletme, İşyeri veya İşletme yahut İşyeri Bölümünün Devri Halinde İşçi Haklarının Korunmasına İlişkin 2001/23 sayılı Direktifine paralel olarak hazırlanan, 4857 sayılı İş Kanunu'nun 6. maddesidir. The employer may transfer all or part of the workplace to someone else. The transfer of the workplace can be defined as its transfer to another employer together with its organized resources in order to realize the economic and technical objectives of an organization or workplace or a portion thereof by protecting its identity. The transfer of the workplace may be in the form of the transfer of the employer's workplace by a legal transaction, the death of the employer, the consolidation of corporations or change of company type. The transfer of the workplace may be in the form of the transfer of the employer's workplace by a legal transaction, the death of the employer, the merger of trade companies or change of type. The hand-over of the company is one of the important reasons that can endanger the job security of employees. The basic regulation about the transfer of the workplace in our law is the Article 6 of the Labor Law No. 4857, prepared in parallel with Directive 2001/23 relating to the safeguarding of employees' rights in the event of transfers of undertakings, workplace or parts of undertakings or workplace of the European Union.
