Abstract
İfa imkânsızlığı, Türk Borçlar Kanunu m. 136 ve devamında düzenlenmiştir. Ancak alacaklının yol açtığı imkânsızlık hali, genel hüküm niteliğinde ayrıca düzenlenmemiştir. Bu konuda yer verilen özel hükümlerden biri TBK m. 485'tir. İş sahibi yüzünden ifanın imkânsızlaşması başlıklı TBK m. 485, iş sahibinin iş alanından ya da şahsından kaynaklanan beklenmedik olaylardan ya da kendisinin kusurundan dolayı ifanın imkânsızlaşması hallerini kapsamaktadır. Buna göre, iş sahibinin kusuru olmaksızın yani iş sahibinden kaynaklanan beklenmedik olaylardan dolayı ifa konusu edim imkânsız hale gelmişse borç sona erecektir. Söz konusu hükme göre, borcun imkânsızlıkla sona ermesi durumunda, yüklenici işin değerini ve bu değer dışında kalan giderlerini iş sahibinden talep edebilecektir. Aynı şekilde iş sahibinin kusurlu hareketlerinden kaynaklanan ifa imkânsızlığında da borç sona erecektir. Ancak burada iş sahibinin kusuru söz konusu olduğundan yüklenici, işin değeri ve bu değer dışında kalan giderlerden başka ayrıca tazminat da talep edebilecektir. İş sahibinden kaynaklanan ifa imkânsızlığı, alacaklının yol açtığı ifa imkânsızlığının özel düzenlemesi olarak karşımıza çıkmaktadır. Dolaysıyla değerlendirme yaparken TBK imkânsızlığı düzenleyen genel hükümlerin de göz önünde bulundurulması gerekmektedir. The impossibility of the execution is regulated in the Turkish Code of Obligations which begins with m.136 and follows this article. However, the impossible situation caused by the creditor is not regulated as general provision. One of the special provisions on this subject is TBK No. 485. The special provision concerning the impossibility of execution due to the employer (TBK No. 485) includes unexpected events caused by the business owner or the working area and impossibility of execution due to the fault of employer. Fort this reason, the debt will be terminated if it is not possible to carry out the execution due to unexpected events without the fault of the business owner. According to the aforementioned provision, if the debt ends with impossibility, the contractor will be able to demand the value of the work and the expenses other than this value from the business owner. Likewise, in the impossibility of execution arising from the defective actions of the business owner, the debt will end. However, since there is a defect because of the employer, the contractor may also demand compensation for the value of the work and other expenses other than this value. The impossibility of execution caused by the employer is a special arrangement of the impossibility of the execution caused by the creditor. Therefore, the general provisions governing the impossibility of the TBK should also be taken into account when evaluating.
