Hz. peygamber (SAV)`in uyguladığı Şer`î cezalar

Abstract

Bu çalışma Hz. Peygamber'in uygulamış olduğu şer'î cezaları içermektedir. Hz. Peygamber yaklaşık yirmi üç yıllık tebliğ görevini gerçekleştirirken her zaman rahmet yolunu seçmiş, muhatabına yumuşak davranmıştır. Şahsî meselelerinde intikam duygusundan uzak durmuş affetme yolunu seçmiştir. Ancak toplumun düzeni için, hak ve hukuk adına Hz. Peygamber'in bazı cezalar uyguladığını görmekteyiz. Hz. Peygamber'in uygulamış olduğu bu cezalar Kur'an'da yer alan cezalar ve Allah rasûlünün dinin açıklayıcısı ve devlet yöneticisi vasfı ile uygulamış olduğu cezalardan oluşmaktadır. Cahiliye dönemi gibi sosyal adalet ve düzenin zayıf olduğu bir topluluğu, saadet asrına ulaştıran Hz. Peygamber'in uygulamaları günümüz toplumunda ahlaksızlıkların açıkça yaşandığı, cinayetlerin adam yaramalarının arttığı hak ve hukukun ihlalinin yaşandığı bir toplum için son derece önem taşımaktadır. Zira toplum düzenini bozan, kişi hak ve hürriyetlerini ihlal eden kimselere hak ettiği cezâ-i müeyyideleri uygulamadan, caydırıcı bir takım cezalar vermeden huzurlu bir toplumun olması mümkün değildir.

This study covers the religious punishments implemented by the Prophet Muhammad. While performing his twenty three years of practice of revelation, the Prophet Muhammad always followed the path of mercy, and acted kindly towards his interlocutor. For his personel affairs, he always avoided yengeance and chose to be merciful. However, we see that the Prophet used some religious punishments in order to preserve the social order. These punishments which were implemented by the Prophet are comprised of punishments stated in the Quran and punishments practiced by the Prophet as the interpreter of the religion and ruler of the state. His practices which carried his society from jahiliyyah to the era of bliss has so much to do with today's society, where immoral things are openly practiced; murders, assaults are higly common and social rights and laws are violated. Because, without punishing the offenders in a proper way and implementing deterring punishments; it is impossible to have a peaceful society.
