Sağlık çalışanlarını tehdit eden hastalıklar ve patojenler: İş Sağlığı ve Güvenliği Kanunu üzerinden çözüm önerileri

Abstract

Sağlık çalışanları mesleki uygulamalar nedeni ile risk altında olan bir gruptur. Söz konusu risk genel geçer çalışma risklerinin dışında hastalıklar ve patojenler ile ilgilidir. Her ne kadar bulaşıcı hastalıklar ve patojenler tıbbi alanın en önemli araştırma ve uygulama konularından da olsa, her ne kadar çalışanın korunması için belli ilke ve uygulamalar belirtilse de konu iş sağlığı ve güvenliği açısından ele alınmalıdır. Bunun nedeni iki başlık altında toplanabilir; biri standardizasyon, diğeri hukuki düzenlemedir. Standardizasyon her çalışana belli bir davranış ve uygulama çerçevesi getirerek riski minimal düzeye getirir. Hukuki düzenleme ise iş sağlığı ve güvenliği kapsamı içerisinde riskli davranışın belirlenerek hukuki yaptırımların kime yönlendirileceğini düzenler. Sağlık çalışanlarının hastalık ve patojenler nedeni ile risk altında olması hastaları, sağlık çalışanlarının ailelerini dolayısı ile tüm toplumu ilgilendiren bir konudur. Geniş bir çerçeveden dar çerçeveye yani sadece sağlık alanına odaklanıldığında bile ülkemizde nozokomiyal ve ameliyathane enfeksiyonlarının hala yüksek oranda görüldüğünü ifade eden çalışmalar vardır. Sorun muhtemelen çalışanların davranışlarında ve standardizasyon sorunlarında yatmaktadır. Çalışmamızın hedefi sorunların çözülmesi için ilgili kanunları inceleyerek çözüm önerileri getirmek ve riskleri azaltmaktır.

There are the general occupational risks for the healthcare professionals but also another layer of risks that comes at least from the diseases and the pathogens because of the nature of their occupation. Although diseases and especially contagious diseases and pathogens constitutes a very important part of the medical practice and research; no matter how much guidelines, rules and practices have been issued and applied in order to protect the professionals of the area the issue must be addressed also within the context of the Occupational Health and Safety. Two main reasons are considered; the first is for standardization and the second for the legal arrangements. Standardization brings forth a certain pattern of behavior and practice forcing the risk to a minimum. Legal arrangements and regulations help to define the risky behavior and address the legally responsible person/persons or institution for that behavior and its consequences. The danger originating from the diseases and the pathogens might harm not only the healthcare professionals but also their families and so on, therefore it is obvious the risks are a concern for the whole society. Even if tht wide angle is narrowed down to the healthcare area the problem is still formidable as it points out to nosocomial infections that are found to be significantly high in our country according to many studies. It is probable that the problem lies on the behavioral patterns of the professionals and standardization issues as well. That is why the aim of our study is an attempt to solve the problems and lower the risks by studying and analyzing the relevant laws and regulations and proposing certain solutions.
